    Legalese in English, bitte.

How does one actually verbally articulate a citation such as...

    In re Tran, 369 B.R. 312, 322 (S.D. Tex. 2007)

    ?

    "In Re Tran"... 369 BR 312, 322

(BR is indication of the publication which is Bankruptcy Reporter.)

I guess you could say "In Re Tran, 369 Bankruptcy Reporter 312, 322, Southern District of Texas, 2007".

Thanks! I'm really hoping that I will never ever actually be forced to pronounce some of these citations at a hearing, but would prefer not to sound like a blithering idiot if I do.

The biggest key is the case name...

GMAC Commercial Corporation ITT v. Niagara Mohawk Power,

        and the publication...

        918 F.2d 19

which is the Federal Reporter, 2nd Edition, Volume 918.

So... In re Tran, 369th (volume of?) the Bankruptcy Reporter, at pages(?) 312 and 322....in the Southern District of Texas in 2007...?

          Wow what a mouthful.

Yep, a mouthful, but you don't have to say "volume" or "th"... just "three-sixty-nine bee-are three-twelve, three-twenty-two". You really don't need the District information, but it's nice if someone doesn't have access to Bankruptcy Reporter.

            Just try mumbling.

Oh. So just spell it out like it is written and that is ok..?

I'm already mumbling. Or is that muttering? ;-)

Ah ... the hard truth is I am THINKING TOO MUCH and shouldn't be worrying about something that hasn't happened yet and might never happen. Time to go to bed! night night jb!

You shouldn't worry about anything at all.

I'll make iti easy for you...ever get a traffic ticket? If so, the officer cited you the law you violated...i.e., "You were in violation of 68 PA Code, section 49." (numbers, etc. made up). In your situation you cite verbally the name of the case, then West's Bankruptcy Reporter Volume 369, pages 312 to 322.

Very rarely will you ever cite a case in oral argument. The brief or memorandum is where you cite cases, you need to approach oral argument like a conversation. But, if you do need to reference a case, you say something to the effect of

"In re Tran out of the 10th circuit held...."

"My circumstances are different than those of In Re Smith...."

Hey Flamingo.... I dunno... the last time I got a traffic ticket was so long ago I really DON'T remember what the guy said. "You were speeding!"? Maybe!? lol! I really don't remember!

Thanks HHM and jb. You guys are so helpful, I really appreciate y'all. But I think jb is right and I really don't need to worry about this. And conversation, I can do. But it might never get to hearing. Who knows. This is about my objection to my claim, btw.
