    Mail Returned to Sender. Due Diligence?

    Another question has come up.

    If I get returned mail from filing notices, and it is for my ex-husband co owner on my one and only secured debt, what constitutes due diligence in trying to track him down? Am I required to file evidence of due diligence with the court?

    Is this a Chapter 7 filing? How much do you owe him? Have you actually tried to determine his correct address (or just used an old one). If it's secured debt, you really need to find them. If they are incorporated, then you can file notice with their Registered Agent. Try contacting the Registered Agent if it's incorporated... do this by phone.

        Chapter 13. I don't owe him anything. He is the co-signer on a note that I am claiming under my Plan, so he needs notice. Geez. Wouldn't you know. The last person on the planet I actually want to FIND and I have to go look for him...

        Thanks Frogger. This afternoon I came up with two possible current addresses for him. I might enlist your help to determine the correct one. But not tonight. Tonight I need to breathe... eat... sleep.

        I had no idea that I was going to need to be a PI in order to file bankruptcy! That was not in the instructions! lol!

          Nah, you don't need go that far. You just need constructive notice and there's more than one way.

            Can I have it delivered tied to a brick and dropped on his head from a helicopter? (just kidding) (sort of). I wouldn't be filing ch. 13 if it weren't for our joint debt that the judge so generously gave me in the divorce.
