    CH. 7 Filing

    Hi Guys,

    I should have filed along time ago. But now I am finally getting to it. I am going to get the NOLO book tomorrow but I have a few questions. I am currently not working and am living with my domestic partner who has a solid income and house, good credit etc. How is the court going to react if I filed without any income? How will this affect the means test. I have not payed on any of my credit cards in two years. Both my cars have gone back to the bank. Audi has not sent a deficiency notice. Ford did but i just received a letter for a court settlement saying they will remoce the deificiency and trade line from my credit report. I have had one judgment filed against me.

    I am sure I am quite capable of filing the paperwork. I am just concerned of the reaction from the court when you have me earning 75k a year in prior years and havent had any income in months.

    Thanks for the advice and hope that wasnt too many questions/info.

    Trust me, the Court understand the plight of the human existence! They understand that well-paid individuals lose their jobs or live at the sufferance of life events. (Wow, can't believe I just wrote that!)

    The key is to have meticulously reviewed your petition (documents), not "lied" or otherwise stretched the truth, and to just relax. For 99% of the people who file Bankruptcy, it goes without a hitch at all.

    You may need some guidance on the "expenses" area of the means test, but with no income, I don't think you'll have any issues.

      Thank you Justbroke. I really appreciate you replying to my thread. I have another additional question I thought of that I am curious about. Occasionally, I will work for a buddy of mine in CA (Im in AZ) and he will pay me 1099 but it is not regularly at all. It is basically when he needs help. How would I go about being honest about this but not shooting myself in the foot at the same time?

        Since you are required to list income from all source in the last six months, I would list any of that income from the prior six months! Besides, if it's 1099 and you reported it on your income taxes, the Trustee will easily see the income on the tax returns you file with the Court and Trustee (since you have to provide those to the Court/Trustee).
