    Call the Clerk of the Court or your Case Manager and ask a procedural question. Ask what's the normal process for discharge and close in the District... e.g. whether they use auto discharge and auto close.

      Hello...all is going well in this very fun process. The last day for creditors to object is 11/23/2009.

      I spoke with americredit who holds the title on our surburban. They had the date down so I suspect they are just waiting now.

      I wish I knew when I had to give the car back or better yet, when they have rights to come get it.

      We are going to buy another car cash and are waiting as long as possible.

      On another topic, I applied for 722 redemtion.(sp) They connected me to a dealer that offered me a P.O.S. kia for $285 a month. We decided to buy a car cash.

      I currently drive a 1995 LandCruiser with 200,000 miles on it. I do the service work myself and it works perfectly. It has never let me down or left me stranded. Id feel confident driving it accross country.

      I am looking for a well made car that is known to go the distance. Toyota, lexus, or a volvo. I'll look for one that needs minor work and do it myself. I'll save on the labor and own it out right. We'll save our money and when we have a few more thousand, trade up.

      We're going to do it Dave Ramsey style and im fired up!

      Again, we want as much time as possible without the repo guy coming to our house or work. When should we give it back voluntarily if we want to wait as long as possible.

      Last day to object for creditors again is 11/28

        In Chapter 7 cases involving individuals, the stay remains in effect until the earlier to occur of the case being closed/dismissed or a discharge is granted or denied.

        read this online. How long after my last day to object am I looking?

          No one can tell you. Depending on your District, the case will either auto-discharge (and potentially auto-close as well), or needs to be manually done. It can take days to weeks before you get the actual discharge. However, you just want that date to pass!!!

            actually, I want the date to be as far out as possible. More time means more cash. I just dont want the repo guy showing up at our home or work

              Well, when I say.. "want the date to pass", I'm referring to the bar date for filling a complaint to determine dischargeability. This is the last day that creditors, and the Trustee, can file to dismiss.

              Now, the time between that date passing and the system actually showing a discharge... is apparently what you want to take a long time. We still can't tell what will happen in your case. You just never know.

                I went down to the courthouse and looked at my case on pacer. I believe it was in the log that it shows the finance company requesting special notice. I had contacted them in the beginning asking for reaffirmation paperwork to be sent to me. Did they need to file something with the court to send that to me or do they get a special notice when it discharges?

                  Any reaffirmation needs to be filed with the court before discharge.

                    Discharged yesterday! Thats great news. I called the finance company today to surrender the vehicle and they said they had to wait till the case closed. The guy I talked to sounded as though he was trying to be very helpful. He said when he got the notice that the case was closed he would call and I could meet someone to drop off the car.

                    How much should I trust that he wont send someone out to my house with a tow truck?

                    I have the car parked right now where I want it picked up.

                    Can I drive it the next few days or should I just leave it parked for now? We are still paying insurance on it and there is some gas in it so I'd like to drive it if I can.

                    Any suggestions or advice?

                      As much as you cooperate with them, they are much more amenable to a friendly drop-off than hunting down the car.

                      Just don't leave anything of value in the car at any time.
