    Pre-BK counseling

    Hi all.

    I just had my pre-BK credit counseling. The woman was over-the-top chipper and polite as can be; however, I think some of her knowledge may be not the most current information. Specifically, she was referring to my Food expense and how it was over the limit. It is not much under the allowed but it is under. She said I would have to justify to the trustee the high expense for food, especially since my income minus my expenses leaves me in the negative. Or I would have to reduce some other expense to allow for the high food expense. She said the trustee would be paying attention to whether or not my budget would balance out. I don't know if she is just saying this stuff to get everything to balance out without a negative....

    The income I used to do the credit counseling was based on the last 60 days, as they had requested. If taken for 6 months, my income worked out about $200 more each month, and I "break even" with my expenses (maybe $10 or so dollars left over).

    I mean, I could decrease the number and still have no disposable income, but what I have down is my average expense.

    I guess my question is...does she have me freaking out over nothing?

    Yes, it's nothing. There is nothing you learned in the course, which even applies to your Bankruptcy in a technical manner You only needed to complete the course.

    I never did the "budget" part of the course, as I already had a budget.

    When filing Bankruptcy, you generally want your net income (after expenses and taxes) should be negative! That proves that you may be insolvent, and certainly proves that you are drowning in debt.

      Thanks for alleviating my unfound fears. I guess I'm just in high-tension mode at the moment! I need to take a deep breath....sigh...much better now!

        Justbroke is right on (as he usually is) but I add, the pre counciling is basically an unneeded procedure. It's so called use is for someone for a fee to tell you that you are either a candidate for bk, or not, or what kind of bk. Now the post filing course is great and is about two hours online, and was more than worth the money to us as we actually learned a bit and it was not dry at all. You must get that out of the way, but you will enjoy it too. 'Hub
