    Reaffirmation Hearing....

    Has anyone here ever attended a reaffirmation hearing on a car - we have to since we are pro se.....just wondering what goes on. I have "read" about what goes on, but I wanted to hear it from someone who has been there.
    We are reaffirming hubby's truck and only he is on the note, and the UST has filed his statement of presumed abuse, so clearly HE thinks we can afford the car. I know the gal from the credit union where we have the car loan is going to attend, and she prepared the documents that were filed.....but what does the judge ask?

    Sometimes, the Judges actually don't ask any questions. They just look at the papers, mumble something about not be in your best interest, and denying the reaffirmation. Okay, maybe not in all cases, but they generally won't/don't have too many questions as they go through probably 100 of these in a day.

    Now the Judge may lecture you on why you're not taking the opportunity to be rid of the debt... blah blah blah...

    I've only been in court one day that had reaffirmation hearings (and relief from stay hearings). Much of it was very fast. There really weren't many questions asked.

      I sure hope it doesn't get denied.....we won't get a rate like this for a looooong time to come! And we like the bank we are with on the loan, and we bank there. It is a good deal, so I hope it goes smoothly.
      I looked @ the calendar for the judge, and even if I take the 341s and put them aside since they don't see a judge - there are about 100 people in the hour before and at our time slot.....hubby will have been up since 4pm the day before and worked all night. I feel so bad for him!!! I hope she doesn't have pressing questions cause normally after he gets off work in the morning he can't even answer if/what he wants for breakfast, let alone a pressing financial question! LOL

          We actually are not going to be going after all.
          My sister is having a baby on Wed and that is just more important at the moment.....so I called the Judge's clerk and asked how/if there is the ability to change the date this close to the hearing, she said no, but we could just no show, have it denied and re submit the reaffirmation with the court and get a new date. She said she would send an email to the Judge and her other clerk as a courtesy, but that we don't have to reaff. the debt so there is no issue with no showing, just to know we would have to re file the reaff.
          So I called the credit union, talked to the BK specialist assigned to us who said it was no big deal and she would re file when she got the notice that we no showed. I said ok as long as we are all clear we are keeping the car, want to reaf, etc - she said it was all fine and not to worry!

          So a little relief for now
