    Min, what's the scoop on your case?

    Still in the "hold" position....... case is still open............

    Judge called for a hearing in August - wants to know why the case is still open...... soooooo now Trustee real quick posted a notice to the creditors that assets were available (he's been sitting with the money in escrow collecting his interest, DUH).....FOR 6 months now..... He will try to get something filed and to the court BEFORE the hearing date, just like he did last year when the judge called for a hearing......

    He better do something cause I'm going to petition the court to close the case if he doesn't.... And I want a full accounting of everydime he got his hands on and where it went...........

    No reason for a Chapter 7 case to still be open 6 months after the assets have been sold............ just dragging his feet...........

    Other than that - still waiting!!!!! And getting paperwork and things "ready to go" towards the OTHER........................

    Just waiting on that closing.......................

      WTF??? Your trustee hasn't distributed any of the $$$$???? Sounds like a trustee, that at the very least, will be getting a very serious reprimand.

        This trustee has done "lots of things" that are in question??????

        And yes, he too will be "doin some xplainin"..... in Court................ right along with all the others that did "their thing" in causing me to loose my home......

        I'm just "waiting" it out.....

        Yeah, he ain't been in no hurry to pay the creditors..........

          Minny, I can't remember - is the U.S. trustee aware of what your local trustee is up to?
          I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

          06/01/06 - Filed Ch 13
          06/28/06 - 341 Meeting
          07/18/06 - Confirmation Hearing - not confirmed, 3 objections
          10/05/06 - Hearing to resolve 2 trustee objections
          01/24/07 - Judge dismisses mortgage company objection
          09/27/07 - Confirmed at last!
          06/10/11 - Trustee confirms all payments made
          08/10/11 - DISCHARGED !

          10/02/11 - CASE CLOSED
          Countdown: 60 months paid, 0 months to go

            Y'know, this is Dateline material. You've got a scumbag for a Trustee, I HOPE TRUSTEE'S look at this site! Most of you are sh*tbags. Just a rant, sorry. Hate the language but I get so darned mad when I think of how they trashed you and drug me and mine through the dirt.

              I'm sure the US Trustee is aware of what the Trustee is doing - it's supposed to be his job keeping an eye on the Trustees..... We'll sure find out later on after law suits are filed......

              Yep, you just might see all of this issue on Dateline or one of the news shows...... paperwork is all ready to go to them.....

              No doubt one of them might be real interested in my story...... it's not "nice" for large companies and the court system to beat up on little ole ladies!!! Society doesn't like that one bit...... especially when its the large corporation's fault.........

              Time will tell the outcome of all this, but I an now ready to 'GETTER DONE"!!!

                    I can't believe that no Trustee or his Attorney has been killed, especially when you are dealing with 13's and such. They can frustrate people to such an extent that you cannot eat or sleep. I just wonder if any BK Court has dealt with an over the edge person. I mean folks come in in a desperate situation, maybe even lost a family member, medical bills, no financial hope and crushed by life's twists and turns. I applaud folks who hold it together, it really takes one heck of a person. I think all of us could handle being short of cash, it is the thought or act of being trashed by someone in power and having your dignity and self worth pummeled that can destroy an honest person.

                    I hope you bloody him/her badly in the Court sense that is. That will damage him far worse. What a pig. BK laws were made for your situation, you are the living example of why we have them, you fit every reason for having them... and still that did not protect you. In your case the Judge has a responsibility. Yes, we are guilty and need relief, none of us argued that, but in this case the judge had a moral duty to give you the relief you sought and to PROTECT your home. certain things cry out for the application of a "Higher Law" and i am certain that the Judge has a certain obligation to recognize that "Higher Law".

                    A person accused of MURDER has the right to and gets a SPEEDY TRIAL, where is your day?

                      Under our court system, you are innocent until proven guilty. However, with BK laws, remember that there is a presumption of abuse first that we have to contend with so we have to prove first that we aren't frauds.

                        It wasn't a case of me abusing the system....... it was a case of a title company failing to record legal papers at closing of a home (thus causing me to loose my home in Chapter 7)..... thru no fault of my own....

                        Negligence of the title company, bank, mortgage company,and my attorney.

                        Their actions 8 years previously caused me to loose my home when I filed bankruptcy......

                        I was an innocent victim...... with a greedy trustee and mortgage and title company (who caused the problem).... and an attorney who "covered his own A$$ when it all come out"..............

                        Trustee even "threatened" me the day of the auction.............

                        Those that benefitted the most at the auction, was the Trustee and the companies that caused the problem to begin with..............

                        Paybacks will be hell................ I'll see to it................

                          You gotta' understand that with Min I was there when she was a L'il BK'er mad, angry and just filed so I know the particulars as far as what she has posted over the years. Man, she is not the same Minnymouth who started out here, she is another person, much stronger now. There was no abuse on her part of any type. We all know that we are guilty when we file, we are seeking relief. While the case is against us and fraud must be presumed until the case is revealed her case cried for justice. What was done to her was brutal, crushing and done I believe by a Trustee filled with bloodlust, this enriched no one, paid no one and was in my book a reason to go off the deep end, and I might have. Hell, I darn well considered it and started thinking about opportunity spots across the street from his Attorney's Office. I am a fairly good shot with my Ruger. Had it been a medical deal with a sick or dead child (GOD FORBID, AMEN) he wouldn't be alive. Fortunately, there is a wide gulf between thought and action.

                          Darn, she is a champ.

                            The trustee wouldn't get to keep any interest on that money. Even when you pay an attorney a retainer, they put that money into a trust account and can't pay themselves out of it until they "earn" the money. Interest on the trust account I think goes to the bar association or something like that.... I forget who specifically, but I know that the attorneys and law firms can't keep it.

                              Yep, I'm a much stronger, wiser person than I was when all this started. And I came out of it "fighting mad" instead of crying and whimping around....... THE STRONG SURVIVE..........

                              I was dumb about bankruptcy and it procedures when I filed...... and relied on an attorney with 25 years of experience..... needless to say - A BAD, BAD MISTAKE!!!! My attorney covered his own A$$, instead of working my case to the best of his ability.......

                              The actions of my attorney is one of the number #1 reasons I lost my home in BK...... the rest of the companies set it up from 8 years ago.

                              Yes, knowledge makes you strong....... the knowledge of knowing "what" they can and cannot do within the laws of the bankruptcy system.......

                              Were my "rights" violated? Yes..... Did the Trustee "screw" me over? Yes...
                              Right along with my attorney and all the companies involved (bank, mortgage, and title).... and the Court showed absolutely no compassion or consideration whatsoever!!! Known as SORRY ABOUT YOUR LUCK, LADY!!!

                              YES, I'M A MAD SURVIVOR..................who will even the score!!!
