Minny, I hope you didn't read my comment as you were committing fraud. I was making a statement in general about bankruptcy and how we are all viewed with the "presumption of abuse" until we prove otherwise--which doesn't fall in line with the innocent until proven guilty guidelines that our court system is based on.

Nope - didn't take it that way.........

And you are right - anything they question, they look at like its "fraud"...... until you prove otherwise......... AND I HAD PROOF - THEY JUST WOULDN'T ALLOW IT TO GET INTO COURT TO BE PRESENTED..........

In my case it was a "clerical error" made by professionals who were paid for their services 9 years ago... in the closing of my home. They failed to transfer the title of my home to me, put it on the deed, and failed to record it.... ACTUALLY, none of it belonged to me the entire 8 years, and nobody knew it..... it still belonged to the sellers. Only the land had my name on it.

Their clerical errors and the lack of efforts of my attorney (trying to cover his own A$$$) caused my home to be seized by the Trustee and sold at auction......

And the Trustee, US Trustee, and Court showed no consideration or mercy to me for the "clerical errors made by the professionals (creditors)".....

The very creditors that created the problem - benefited the most from the auction - I LOST EVERYTHING............. No homestead exemption - NOTHING...........

I took a $90,000 cash loss of investment over a 8 year period THANKS TO THEIR "CLERICAL ERRORS"............... (this included downpayment, interest, payments, insurance, property taxes, major land improvements, garage, major home improvements to the home, etc)

I walked away with the clothes on my back and a few personal items such as furniture, etc, old car...........

I'M THE ONE THAT WAS PENALIZED FOR ALL THE "CLERICAL ERRORS"..... THEY SEIZED AND SOLD MY HOME..... NO QUESTIONS ASKED............. NO WORKING SOMETHING OUT - NOTHING.................

I was denied the right to buy back my home at FMV thru the Trustee - the mortgage company demanded an auction............

Also the Trustee sold things at the auction that were not even mine - items that were sitting on the property and others owned. The Court had granted a sale of the home and land only in the petition - nothing else! Yet he sold all items.... and took all cash available the day of the sale.....

So lots of things went on in my BK that was totally uncalled for - basically crooked, and I was penalized for mistakes made by all the professionals.

Not only was I victimized by the "professionals" (creditors), but also by my attorney, the Trustee, the US Trustee, and the Court Judge... None showed any mercy or consideration for what had been done to me - they all stood there with that "greedy look in their eye" and "their hand stuck out" for THEIR SHARE.................

I filed bankruptcy for forgiveness of my debts (was reaffirming on my home and they wouldn't let me because of the clerical error) and the "protection" of the court................... DUH ----- INSTEAD MY HOME WAS SEIZED, SOLD, AND I GOT SCREWED BY ALL OF THEM....

So when I go after them....... I will go after all of them.......... bar none.......

What are they going to take if I do........... my clothes?????

My BK was very unusual, maybe one in a million like it.......maybe more!

But it ain't over till the "fat lady" sings...... and I'm the "fat lady" that's gonna sing like a bird!!!!!
