    Feeling anxious and stressed

    Thought we did our homework prefiling, we may not have...it is too soon to tell.

    I am nervous as I write this b/c I am hoping that responses to me will be tailored through a voice of compassion.

    Ok, attorney shared prefiling, that contracts signed prefiling are hypothetical for postfiling commissions due and we can't count them as income. Made sense to us - but now it looks like they will be closing. It's "possible" not set in stone yet, but those commissions could put us into a 13. We have an attorney who will fight for us to pay some commissions (if they end up closing) as assets to the Estate to keep us in a 7.

    We are ok with that. However, if we are asked to convert to a 13, would anyone think it wise to have 13 voluntarily dismissed, take money and try to use a debt settlement company.

    Please be gentle with me as I know how most feel about debt settlement companies and also we have already filed for a 7. This question may be ridiculous. It is hard for me to think some questions and not ask, as you all have been so helpful in assisting people to make good choices where they currently find themselves.

    I just need some hand holding right now.

    Ok, I think I have my own answer. It would not be the wise thing to do. I apologize for posting this question if it has been asked before.

      do not apologize at all, i apologize that no one was able to assist you with your question!

      it's difficult to decide which is best for your situation if you have the choice of a 7 or 13. NO DEBT settlement co. they make a HUGE commission on what they have you pay. it's a loose, loose for you.

      if you feel best with a 7 you may want to consider to try and wait it out a bit to file? is that possible to do, since it sounds as though this extra income is not steady?

        And I apologize for not answering your PM earlier; I thought I had.

        Since you have an attorney that seems to be working well on your behalf, go with his/her recommendations. That is what you paid the attorney fees for. I know you are very worried and upset about all of this, but as one of our attorneys told us--"you don't have to worry, that's what you pay ME for..." That wasn't our BK attorney, but the one defending us against serial harassing lawsuits.

          I think they already filed a CH7..... and are worrying about it.

            Yes, we did file a 7. Thank you, everyone is very kind. My heart is burdened mainly for my husband now. It's ok, this whole bk just goes against the very fibers of our being, of our soul. We will press on, as so many of you have done before us and with us. We are no different. AngelinaCat, I am amazed by your story...you made it to the other side.

                newday, we all felt the guilt, the shame, the emotional roller coaster, the tears and fears...and finally the CHEERS...it's a hard one to go through, but you will make it! i know it doesn't seem like it now, but you will.

                try if you can to shelf it for a few weeks and relax and attempt to enjoy the love and those around you for the holidays. in the beginning and end it's really all that matters anyway

                  Please keep reading our stories, 6 months past bk 7 then 1 year out, keep reading. The new life and second chance to get on the right track is beyond words. Your health and your attitude will be greatly changed a year from now. There are much worse things in life then filing bankruptcy, the big banks and big companies do it daily (would you stop doing business with every company that you knew filed at one time or another???). Learn from this process, make a business decision and move on to make better decisions and go forward. None of us did this lightly and the lesson is a big one, learn from it, go forward. You do not have a big "BK 7" on your forehead, you will get through this and be on the road to recovery sooner than you think...

                    All the above posters have already said what many have felt. You will make it though the other side. Many of famous people have file BK and gone on to succeed in business just like you will do when you get your fresh start. BK is not a punishment it's a tool to be used to learn from and start over again.
