Informing collectors about retention of attorney?

    Once we retained our attorney, she told us to defer any and all creditor calls to her office, period, and end of subject. It was another year and four months before we filed, so we did not have a case number to give...

        let me clarify. they can continue to call and usually do until they get notified by the courts. i'm not saying they all do, but they have the legal right to go after the debt until the actual stay is executed from the courts. when we first started our journey, i thought i did the "right" thing by spending a small fortune on sending C & D all certified clean and spiffy. all the creditors put them in the trash and continue to call day and night. go to plan two: atty sends out letters AGAIN to call creditors advising them to direct all calls to their legal offices and do not trouble our clients again. it didn't matter....they would start at 8 am and continue up until 9 pm 7 days a week until we left our home and they couldn't find us anymore. our atty explained some just don't care about these letters, nor by law do they have to until the actual filings.

        they contacted everyone with our last name in the phone book, we knew this because some were family. when researching the actual laws on this, unfortunately we found that they can indeed contact others in attempt to local you, however, cannot continue if once they are told you know nothing or their whereabouts.

        true is, one still owes the debt until it's discharged in the bk. so there are laws that work both ways, for the creditors as well as the debtors. we ended up dodging all calls for the next 2 years by our moving and leaving no infor, nor getting another phone etc.

        you were one of the fortunate ones if your calls stopped
