    Paid property tax with credit card.

    About a year and a half ago I paid half of a property tax bill with a credit card, the other half cash. At the time I did not know that I would be considering bankruptcy, or that paying taxes with a credt card is not good idea. I have an appointment with a lawyer next week and will definitely tell him about it. In the mean time, I am wondering what impact will be. Do we have to declare it, or does the credit card company have to notice it and challenge it. It is a realatively small amount about $1,400. I guess we would have to pay it back.

    Using the NOLO means test, it looks like we will qualify for chapter 7, but not sure of that.

    Nobody is going to care about a cc charge from 18 months ago.
    Let your lawyer know but, the cc company would have to file the adverserial proceeding. You don't need to volunteer anything.

      Probably not an issue, to long ago for anyone to care.

      Although the issue is not fraud...the issue is simply that property tax is a non-dischargeable debt. Any refinance (e.g. paying with a credit card) of a non-dischargeable debt makes that new debt (the credit card charge) non-dischargeable. But, the bank would need to show up and file a quicky AP, not likely to happen on a debt 18 months old even if it is a slam dunk case for the creditor.

        I can attest that it just depends on the lender. I paid $$$$ in property taxes on a credit card. The creditor never filed a dischargeability complaint, and the card was discharged.
