    We Filed Today !

After spending about three hours at our lawyer's office today, we are officially filed as of three hours ago! Our lawyer and paralegal did it at the end of our petition appointment. I have to say a huge weight lifted from both of our shoulders after that!! On the drive home, a creditor called me and I was more than happy to give them the bk case number and info LOL!!! We should have our 341 around mid-July and we talked about that today. Thanks so much for this forum for making this process easier for us!!

Thanks guys, it's the best we've felt in a long time. You gotta love Capital One. I got a call from them not too long ago and she was trying to get me to agree to some stupid collection statement which I would not. I gave her the case number, filing district, attorney's info and finally had to say thank you and hang up the phone. It was something along the lines of if they didn't get the filing notice in an appropriate amount of time then they would send the account to collections? It was odd but just kept repeating the bk info I was told to give.

              Yay for you, Tater!! Congrats!

Capital One said that same thing to me. If they did not receive notice of filing from the court within so many days - blah, blah, blah... Of, course I was talking to "Peggy".

Yes, I am quite enjoying this myself and so is hubby, especially with the ones who would never work with us which is about most of them!! Hubby had a large medical bill that we've been paying on for years and they called tonight threatening a law suit...Oh, that was a fun conversation because the collector felt defeated after we told them we filed for a Chapter 7! Honestly, we are just so grateful to be given this opportunity of a fresh start and finally get our lives back! We have learned our lesson about credit and have a good budget in place that we abide by. It's such a relief that we only have to make house payment, car payment, and utilities from now on!

Yeah, we were there. We had been dutifully paying as agreed on one of 'Hub's medical bills from his 2004 prostatectomy. We had gotten it down from about 5K to about 1K or 1500+-. Then we got a rude letter informing us that we were being taken to court as we "had broken our payment agreement". We fired a nasty letter back stating that WE were paying as agreed, that THEY, whoever THEY were, had broken the agreement by sending such a letter, and that we were no longer paying them.

Also, we had a loan with American General, and were trying to pay it back, but as our employment situations changed--and we tried to keep AG informed--they decided not to work with us.

So, we were very happy to BK against these two.

Congratulations, Tater! We'll be filing very soon as well. I turned in paperwork to our attorney yesterday, and it already felt like a relief.

Congratulations, doesn't it feel good to finally be able to breath? You are too polite, when the creditors called me I just gave them my attorneys name and the town/state and told them they would have to look up the number. If they wanted to call him let them work for it that's what they get paid to do. They didn't want to work with me so I had no intention of working with them.
