Welcome to BKforum. There are members who have filed prose. It is not to be taken likely. If you file prose, you are your own attorney and are expected to know the law and procedures like an attorney would. If you decide to file prose, expect to spend many hours familiarizing yourself with the Bankruptcy Code, the Federal Rules of Bankruptcy Procedure and your Local Court Rules. It has been described as being like a full time job for a while.
Even if you plan to file pro se, you should consult with a few bankruptcy lawyers about your situation. Most offer free consultations.

Hi LadyInTheRed, first of all, thank you for replying. I feel so down right now because of our situation. I've been crying almost every night out of frustration. I just don't know what to do. This is my situation and I really don't mean to vent but I feel like I need to otherwise I would probably just pass out.
My husband is being sued by capital one for a $8000 cc debt that is only in his name. Now, we live in Louisiana which is a community property state. I am so afraid that capital one will garnish our joint account because I've heard it happen to other people. We have about $2900 in our checking account. My husband makes about $1850 a month and our expenses is about $2700. We are using the money we have left to cover our deficit. I don't work because I go to school full time and we pay daycare $460 a month. We really are not behind on any bills but are just paying the minimum. I have cc on my name only and I've been using them to pay for tuition and books. I just don't know what to do. I mean, if it's not for this lawsuit and possible garnishment, we probably won't think about this bk thing. But right now, I just don't know what to do.
As for our assets, we live in a mobile home and are current on our payment. We have 2 cars, one is paid off, and the other one is also current on our payment. I guess my question is if we file for bk, should we reaffirm the mobile home? Btw, we don't really intend to stay here in Louisiana. We are planning on moving out of state as soon as I get enough experience in the field I'm trying to get a degree on.
Again, sorry for the vent.

Hi and welcome. If you read many of the posts here on these forums you will realize that we have all been there or are presently there. Read as much as possible here as you will get so much information regarding your situation (there is probably a post somewhere similar to yours I am sure) and the different options you have. Yes the one thing you will learn here is that you do have options and you are in control, not the creditors or anyone else. If this is something you are thinking about then you will need to have as much info as possible. The first thing I would suggest is that you might want to set up a couple of appointments with bankruptcy attorneys, the consults are free. Go armed with all your questions about your present situation. Keep making appointments until you feel comfortable with one and feel they are the right one. When you know what you are dealing with then you will feel much better and in control.
This is a place to vent, vent away. We have all done it and some of us more than a few times . If you need to cry then cry get it all out then come back and ask a lot of questions we will be here.

First, let me say, welcome to the forum!! I have only been here around a week and I have vented a few times already! People have shared their experiences and answered my questions. I agree with the others, go to free consults with bk lawyers. My husband and I are in the process of doing this ourselves and we are slowly finding some peace of mind. I think the fear of the unknown is what bothers me the most at times. I have to admit that I feel a lot better now than I did a week ago. Please don't get down on yourself if you and your husband have to file bankruptcy. Like so many have said, it's a business decision for your family. I've cried, worried, and about drove myself insane through this so far. (Along with my poor hubby)
As Drazil65 suggested, consulting a bk attorney to discuss your situation will help you guys in deciding the best course of action. I can't answer specific questions but just know you aren't alone. If you have the time, read as much of the forum as you can. It's a great learning tool!

welcome here!! yeah some people here filed bk on their own, some hired an attorney, but the best for sure a reference to use is the NOLO book, not because im selling their books, but they are very reliable, i've used it many times and most of us here love it. Anyway sorry that u are struggling, hang in there, if there's a life theres a hope hope that put a smile on you..
I would consider asking the creditors for a payment plan, if they are not willing to do so, then i'd take as much cash as i can from my bank, but leave few hundreds. and start reading a post here and also consult a bk attorney, ask them questions etc, i believe some lawyers offer free initial consultation,
but with ur case i believe u dont need an attorney, just study the book of nolo and ask questions here, thats what i did, NOLO BOOK and BK forum equals discharged!

Thank you all for your replies, so today we're going to have an appointment with another lawyer and he asked us to bring some paperwork for him look at like list of creditors, bills, tax returns, monthly expenses and all that. I'm still looking forward to file pro se because we really don't have any money and the money we have left is being saved for my upcoming tuition, and other expenses. I'm definitely going to buy the Nolo book. I will give an update about the appointment later today
