    Post BK life...and question

    Hello all,

Although quite some time has passed since I've last posted, I had a question regarding post bk life.. First off, I want to say that life has been good and all the stress and "trauma" of filing bk are long gone. Life is pretty normal these days and I am MUCH better off since filing..This forum was a godsend for the years I was logging on every day for questions and emotional support.

My company is relocating me and I am in process of moving to another state. For the first time in 5 years, I need to get a certificate of closure from bk. I have logged on to PACER and although it clearly finds my name, it says "no cases found for that person". Anyone have an idea what that means?
    Filed 8/25/06, Discharged 11/28/06, CASE CLOSED 11/14/2007!

What do you mean by "certificate of closure?"

We are over five years past discharge of our Chapter 13 and have found that while life does get better after filing BK (time is your friend after a BK filing, that is for sure and nothing happens overnight), we have found that when one files bankruptcy, it never really goes away. One example is our purchase of a new vehicle the end of last year - I had a credit score of 836 (now 809 after the car purchase) and was still refused credit by a bank that took over a bank which we included in our filing - the reason for the denial was that we had previously discharged debt with that creditor. So anytime in the years to come, if one files for credit with any creditor or entity they may be affiliated with or merged with/purchased and that creditor/lender was included in your filing, you could be on a blacklist and will never be granted credit with them again. We were able to finance that vehicle, though, with many other offers from various banks/lenders and that was due to how we conducted ourselves in the years after discharge and handled our credit.

Then also there is the dreaded question that can be asked on any form for employment, credit, etc......"Have you 'ever" filed bankruptcy."

As to your PACER question, I am not certain if PACER archives cases after a certain number of years but filings are not eliminated. Any background search will expose a BK filing depending on how far that search goes as it is public information.

Brendan, make sure you are accessing the PACER info for your bankruptcy court, not regular court filings.
