    Impatient and annoyed.

    Two weeks ago, I signed my petition, and was told by the paralegal that it would be filed within a few days. I took "a few days" to mean within the week. I have called three times since to get the case number, only to find out that my petition has not yet been filed.

    They explained that, with it being tax season, everyone is filing now, so they got behind. I get that, and I'm sure they are working diligently to catch up. I also understand that there are people with more pressing circumstances than my own. If someone is facing a bank levy, then, by all means, let them go first. But, I was told on Tuesday that I was near the top of the stack, and, as of this morning, I'm still not filed.

    I don't want to be the annoying client, but it's been TWO WEEKS! Something's gotta give. I paid them in full. How much longer before it becomes completely unacceptable?

    I want my discharge!

    Did you go to a large law firm that deals in hundreds of BK's? I stayed away from them and went to a 2 lawyer firm where they move things along more quickly since they do the work themselves and don't use a paralegal. Besides, I've known him for years. I signed my petition last Saturday and he said they would be filing by Wednesday. When I get the letter with the meeting I'll find out the case number so I can take the rest of the Means Test. I can understand the BK courts being backed up but not the lawyers filing. I actually work for attorneys but neither of them do BK's. Keep calling them, the squeaky wheel gets the grease. They'll want you off their backs.

      It isn't a very large firm. Just four lawyers, and a few paralegals. They have a pretty good reputation, I guess that's part of the reason they're busy. Every time I go there, there are always at least two other clients in the waiting room. I'm just miffed that it's taking so long.

        Hang in there lotsahats. It's understandable that you are annoyed. Attorneys shouldn't make promises they can't keep. But, it will happen soon. The sqeaky wheel does indeed get the grease. I suggest you call again on Tuesday if you haven't heard anything. After being told you are at the top of the list, calling once a week seems reasonable.

        I think you are confused. The means test is part of the BK petition. Maybe you are confusing the means test with the debtor education course you have to take after filing and before discharge?

            Our attorney was one person in her own office with one assistant that was not very good, after he replaced the good assistant that left for other pastures.

            We begged this person to finish up and file our case. She kept dragging her feet until we went and camped in her office on the last possible day of 2007 (Dec. 28, 2007). This was after she had had our case since August 2006. Had she NOT filed on Dec. 28, we would have to wait six months and a day, to file because of a yearly stipend from a retirement instrument that pays out in January.

              Dang, Angelina! I can't believe they dragged their feet for four months!

              I was going to just leave it alone, and let them get to it when they get to it, but, just a few minutes ago, I received a letter via certified mail from one of my creditors, threatening to sue. So, I called the attorney's office, and FINALLY got a case number! It's done!

                      Congrats on the filing!

                      I'd have been annoyed also. I expect people to do what they say - especially when I'm paying them.
