    Am sorry to take so long to answer questions. we will go talk to a lawyer that will not charge us to much money soon this week to find out how to try to keep are house another way. We can not pay both our house payment and the money to the court too for the chapter 13 we filled out the paperwork for. We only have one car but nothing else. And my wife hit something and we can not fix it right now either. Are oldest girl is finish college soon now and we did not have to pay for that thank goodness. Maybe she can get a good job soon and help pay. We have to pay are credit cards too but we always send each one just 10 dollers at the beginning of the months even though they say we owe more each month.
    If we wait until the next time they county tries to sell are house we will then do chapter 7, is that what we should ask to do? I read on internet today and it looks like maybe we can still stay here and not have to pay any thing ever again. ??? This is so confusing and maybe a new lawyer can help us better than uncles freind.

      Ok, I'm not understanding this. You are in a chapter 13 yet you pay your credit cards $10 each a month? or did it get dismissed.

      Whatever you read on the internet that says you can keep your house and never have to pay ever again is wrong. I would suggest you retain a good bankruptcy attorney.

      I'm also not understanding how you qualified for a chapter 13 with 7 people in a household and your wife working only PT and you selling food out of the back of your car twice a month.

      This almost doesn't seem like a real post but I'll give you the benefit of the doubt.

        No are cards went away but we still could get 2 new ones because Ahmed put some money in are credit union so they could see we had some. We do not pay that much though and for the 2 cards is only around 400 dollers. We can buy food with wifes money now and also pay the electric, dish tv and phones. But it is bearly enough to pay just those things.
        When we did the test with the freinds help because he speaks better English we had just 4 chilren. They said they would let us do it and that we had to pay the house again plus the smaller bill to court. But since that time we have a new pretty baby come in Nov!!! And now wifes father moved in so other family could give us money to let him stay with us but we still do not have the money to pay all the bills we have to pay.
        Will the other chapter 7 let us stay in are house? Do you know this? I know I will ask the new lawyer when we meet.

          Also I am sorry it is maybe hard to explain very clear. And I forgot to say that I like this big house but maybe we should try to sell it? We paid 415,000 dollers and I think we can get even more if the bank will let us try to do that.

            You can't afford your house. You knew it at the time you bought it, but you were talked into buying it anyway. It's time to accept what you knew from the beginning and accept that you cannot keep the house. If the house is really worth more than you owe, you can and should sell it. You don't have to ask the bank, you just have to sell it for enough to pay expenses of sale and pay off the bank. But, if you are still in a Chap 13, you need the trustee's permission to sell. If you can't sell the house, you can live in it until the bank forecloses. This could mean living it in for free for several months, a year, or more. But you won't be able to live there for free forever.

            Other posters have understandably wondered if you are a troll. If you aren't a troll, the problem seems to be a language barrier. So, lets try a couple of simple questions: Are you still in a Chapter 13 bankruptcy? Did you use an attorney to file your Chapter 13?

              Confusing. How in the world can this person even be considered for a chap13 with only one person working part time? More importantly....just about a half million dollar house with only one person working part time?

              Seeing a lawyer to get this straightened out is what should be done.

                Yes LadyInRed I did know this but everyone thought we should have it for many good reasons to try to get food busness get going again and maybe not get into trouble as this is on land outside of city. Wifes uncle has a good business doing car repair and has been giving her money to help us but we have to try to do this on our selfs. We have a lot in the credit union and it makes us look better than we are. He sponcored us to come here in 2001. His busness partner is a lawyer in main work but he does not do the bankruptcy work normally. He speaks more clearly so we can be understood to what we want and so yes we have him but I think it was a mistake. We found out today there will be something where they have taken away the stay which lets the bank get the house again so this is now 2nd forclose since last year. The court case is being dissmissed or I guess that already happened a couple weeks the note election says 28/2/12. Family is against it but I want to sell house and start over to buy another what we had before. You all are very right and this has been good advise. We see the new lawyer that will be free for a meeting to find out what to do on Wednesday. Thank you to every body you have been helpfull. It is what I think has to be done and not try to do the other bankruptcy file.

                  It doesn't matter what your family wants, you are the one responsible for your bills. I'm confused by all you are saying so my advice to you is to see a BK lawyer and not listen to a lawyer that doesn't understand BK's. Most lawyers out there will give you a free consultation to see where you stand in filing. Talk to more than one of them until you find one you are comfortable with. Some will also work with a payment plan for you. I know it seems ironic that we have to spend money to stop paying money but in the long run you end up saving a lot more than you will be spending on an attorney. You can not live in a house forever and not pay on it, a year maybe since it takes time for a foreclosure to go through but that's it.
                  The only reason I can come up with that you would have to file Chapter 13 is because you have a lot of equity in your house. Is that the case?
