    selling car before judgement

    ive been sued by a cc jdb...i have 20 days to answer.... can i sell my car on craigslist to a stranger, before i get a summary judgement? its paid for and has 14k, equity ?.. can i trade it in on a car so that its financed?

    i know that it can be seized in florida, but on a lawyers forum, they are saying that it probably wont be.. anyone had any personal experience?

    my lawyer refuses to answer my calls..

    Why sell it?

    It is unlikely your car would be seized by a judgment creditor. And in any event, it wouldn't really solve the problem. What would you do with the $14K. Having the money is a FAR MORE attractive target than the car, itself.

      have you filed bankruptcy? i'm really confused at what you are trying to do here. because if you have filed and you sell the car, you are setting yourself up for a real problem.

      again, as in your other post, if you have filed, this should no longer be an issue since this creditor should have been listed on your petition and will or should be included with bk.

        its a long story, that has been brewing for 3 years... i hired a lawyer to file bk.. he took 1300 bucks and told me that since my income is exempt, i would be better off to do nothing, or get a ch 13.... he said let the SOL run and i would be ok.... so, after 3 years the hounds got quiet...

        then i got sued by a credit union and got an 8k judgement...now i have an 11k suit to answer.. the lawyer has since abandoned me.. i just bought this jeep 2 months ago, the jdb must have software that kicks out assest..
        in 11 more months, the SOL would have run..

          so you are not in a 13 and he took your money. i would contact the local bar assoc. if that's the case.

          you still need to find another atty. i know i was in the middle district in florida and there are many attys that to pro bono work. so contact the local bar for two reasons, first this person who left you high and dry and secondly for a referral to someone that can help you.
