If my husband files for BK and we have a joint brokerage account, will that account be affected?

Before you jump too far ahead, simply taking his name off the account will NOT solve the issue.
But yes, if this is just a non-retirement brokerage account, the question is whose money is in the account and does your state provide for any exemption to cover it?
Now, if you can prove all the money is yours, non issue. If it truly is a joint account, and the funds come from you and husband or other commingled accounts, then half the money in the account (his half) is probably fair game. And as stated above, simply taking his name off the account will not change that fact and will actually make things look much worse and invite more scrutiny on your case.Last edited by HHM; 01-23-2012, 06:21 PM.
