    Retained attorney today!!!

    Hi,

    We retained the attorney today. We will know in a couple of weeks after she goes through things if we are 7 or 13, she is hoping for 7. We also talked about husband filing on his own (as the foreclosure on his old home is our main reason for filing), but I have more unsecured debt as most things have been in my name due to his credit. We won't be able to file probably until March as we hit up our OD account in December when our pay was all screwed up - so have to wait for that time limit to pass. We talked about paying it off, but she does not suggest we do that.

    She doesn't seem concerned about the new truck. She said the payment is a little high, worse case scenario would be tt would take it back, and we would not be obligated for debt, etc. She doesn't expect that to happen.

    She does suggest that we change bank accounts - especially before we file.

    When we got home, DH was served with summons that BOA is starting foreclosure proceedings. Will be sending her that today.

    So, I feel so much better - she took a lot of time with us and didn't feel anything was a big deal at all. I will feel so much better when she runs all the numbers and runs things different ways to see what she suggests doing.

    P.S. If we do have to return the new truck, anyone have a 1999 Chev S-10 Extreme in black they want to sell????

    I know this has been hard on you! Now relax while she runs your numbers - she knows how the trustees work in your area!

          Congrats, huge step in the right direction. Sounds like you are pretty comfortable with attorney and that will make a big difference. Yes, on changing your bank accounts, pick a bank where you have no other relationship with them (no CC's, no loans, etc). That way you will not risk having your accounts frozen for a cc or loan not paid. Also, set up your Google Voice acct and contact all your creditors to "update/change" your info and give them the new phone number. Life saver. Start gathering your paperwork for filing and take your online course (before filing). You have plenty to keep you busy so good luck and good job on the first step!

                I'll take that as a no. And I was looking forward to a road trip to deliver it! Oh, well. I probably couldn't talk my husband out of it anyway.

                  I'll keep it in mind, but my husband is a Chevy/GM man - and when we looked at trucks recently - he only wanted black. He really misses his old truck even though he likes the new one. So we will be OK whatever happens. ;)

                    Off topic: I love those little S10's. Really are nice little trucks. Used to have 2 of them. One had a custom built dual supercharged 351w (Yes I realize its a ford engine.) in it, Although it kept destroying the rear end, even after we beefed it up. It had soooo much power....
