    How long does it take attorney to prepare paperwork and file?

    Hi,

    We are still hoping to file this month, but wont have money for attorney until 12/30. The reason i would like to file this month is my pto is being paid out which falsely will increase my average income. Or, if there is a way to explain that it was a weird circumstance and not usual can it be not counted? Also, my husband's pension etc will probably be paid on the 30th as the first is on a holiday.

    Am i just worrying too much and just file in January/February? Our attorney had wanted to wait until after taxes were completed to make sure we either spent refund or were able to show we had to pay.

    I don't think you have anything to worry about. A one time income event can be explained, it really just depends on how close you are to the borderline.

    I wouldn't worry about it, your attorney does sound like he/she is looking after your best interests with the tax refund issue.

    But in general, as to the question of how long...it really depends on the attorney and type of firm. On average, for any firm with a busy practice (as opposed to the newbee or attorney that has trouble getting clients and therefore has ample available time), the process will generally take 2-3 weeks.

        Does the spending of the tax refund have to be justified. We could use a new oil burner. It will save in the long run. Wont get refund till early Feb. Credit cards were last paid during October. How am I for time?

          You should be OK in all respects, presuming you file very soon after you've spent the refund...

              My math was that the most aggressive creditors (rare, but not unheard of) could possibly file lawsuits after six months, which would be in April...that's where *very soon* came from...

                If the Atty has your paperwork organized and in the system, he can file it as soon as you pay him. But still don't rush unless you have too. Listen to your Atty, he knows the trustees.
