I was impressed with the attorney we met Friday, but today, this attorney was absolutely wonderful. She took 1 1/2 hrs time to go over things with me, and explain things.
Basically, we don't have to file, but if we want the judgement that will come with the foreclosure to go away we can. My husband's income is protected, and my name is not on anything.
We really would like to get this over and done with. She gave me a huge packet of information to fill out. She wants to wait to file until we do our taxes in January to see if we in fact do pay. If we get a refund we will file after we receive the refund. Also if we end up in a 13, we can cram down the car loan that we have. She feels that with our income there is a possibility to go with 3 year payback if she can exclude the VA income. She also said our payment should be less than what we are paying now, but I do not have an actual amount of what that would be.
She also helped with guiding me on what type of expenses that we should be looking at if we didn't have the unsecured debt payment. Things like dentist, medical, glasses. Also perhaps adding some different insurance.
I also jokingly asked her about getting another car payment and she said that would be OK if we thought we could do it later.
So, not sure if we would get a car - but any good places to find a car with bad credit????
The big thing is she was a keeper! She was unhurried, took a lot of time with me and wasn't pushy about doing anything. She also said we must stop paying debt management company as if we file and stop then the trustee will question that we had been paying all along. So, I called and we have $315 refund coming our way!!!
