Please critique our expenses - atty wants detail to see if we will qualify for Ch 7

    Maybe it depends on the area you live in, but I believe the 'Charitable Contribution' would be fine. Especially if its in the form of a Tithing to your Church, or something like that. I would think the Courts step lightly in that area. Our atty. has as much told us that they do in this area.

      RV is 1977 chinook. Worth maybe $1000. Aqua finance is a company we went with for water purification. Atty said they would remove it. We've had it probably 5 years and don't really care.

      Timeshares are paid for. I asked about getting rid of them. Atty said we needed expense for maintenance and taxes. He only reason I listed vacation was because we took one and attorney wanted everything listed to see where we are.

      We have 2 of our kids on cell plans along with our father.

      Like I said before One of our grand kids lives wih us part time but we cannot take any of that off.

        Cell phones for kids is not likely to fly (but that will be district specific).

        When it comes to assets, it is the cumulative effect that is the issue. by itself, the RV may not be in issue, but you start combing it with timeshares, tax refund, non-exempt cash, then the trustee starts taking everything they can. But again, you will not likely get to take an expense to maintain a non-exempt asset.

        Keep in mind, you can claim whatever expenses you like; the issue will be whether those expenses survive objection; some of what you listed wont. It doesn't take much (a couple hundred dollars here and there) to push someone into chapter 13.

          Thanks! That's why I am posting everything. I didn't use the sch j I used DR budget sheet to make sure I had everything I could think of listed.

            My husband doesn't think Aqua is secured if it isn't we will take it out. Well we may take it out anyway.

              I have all electric in winter my bill goes up 475 a month and I turn rooms off. I would increase that a little plus they are always raising rates. Is the 370 for repairs? Wow thats alot. Prob get 100 Do you only have 1 car? You could make your own cigarettes for 10 a week if you buy a machine.

                Our electric last year went up as high as 285. I had averaged to about $150 - so should I increase this?

                Also, we have two cars. One car payment, one is paid off - which is an older truck (1998), that had been in an accident and had repairs. I took last year's average, so maybe I should adjust down?
