I'm back. I'll be posting a lot so I'll try to keep this one simple. Hubby and I filed a chap 13 in 2007 and I soon converted to a 7 and was discharged. Keeping the house was most important to us back then. I took the bk seriously, hubby didn't. He just can't adjust to living frugal. Twice we have almost lost the house due to non payment. I don't know the tech terms right this minute but we are under the watchdog and if late on another payment, the mortgage co can file something for us not keeping our end of the bargain. Gosh I miss my memory.
Long story short, our marriage is rocky and a joke. We are existing. We are broke all the time. Lack of money is always an issue. I want to pay the mortgage before anything else each month and then the cable, cell, auto insurance, whatever....gets shut off. Obviously, our debts exceeds our income.
He is having an affair with his ex wife (we have been married 24 yrs).
I am disabled. I have CHF, pacemaker but can't get disability because I didn't pay SS when I had my cleaning business prior to heart attack. I filed IRS but no SS. I was dx with cancer in 07 and that has come back twice.
I think hubby only has this next yr or part of it left on his chap 13. He pays 100 dollars a month to trustee. Yep, only 100.00.
I need direction. Is it in our best interest to convert to a 7? I have no way to support myself unless I am divorced and then maybe can get some kind of pitiful disability. To be honest, I could be happy in a camper with my cat. I'm tired of the lies...tired of having to give hubby daily pep talks.....tired of pulling him through life.
Please don't judge or flame. I can't post privately to some of the ppl I know through this forum. Maybe this may help others who are in the same boat, although I hope they're few.
Does the bank automatically get the house if we convert or will there be time for us to save the $1200 a month? Sorry, meant to keep this shorter.
