    New Questions

    I don't know how long it's going to take me to save for a bk. We keep hitting roadblocks. (sigh) Two steps forward, one step back.

    So, assuming the worst happens, does bankruptcy automatically vacate judgments against you or do you have to do this yourself? If I have to do it myself, will there be a fee?

    I was still paying my creditors three months ago. Bankruptcy hadn't even entered my mind. I haven't been saving any of my credit card statements. Will that be a problem? I haven't read anything on here about attorneys needing to see them.

    You may want to try to save the latest ones so your balance and creditor address info is correct for your petition.

    Our attorney did not ask for statements, but I had gone to the online site for each credit card and printed them off and saved the PDFs to a thumb drive.

    I am not sure on the judgments, but I am sure someone will chime in about those!

        I'm filing for C-13 and I wasn't asked for any of them. Just the creditors name, address and balance.
        Filed 11/17/11 Chapter 13, 341 meeting 12/21/11. Plan confirmed 1/19/12 - DISCHARGED 12/16/15

            when you fill out your actual petition you will list the docket numbers of the existing judgements. then, after your close and discharge (with a chapter 7), you will file a motion to vacate those judgements. if not, they will just sit there on your record.

            you can file the motion yourself, or have your atty do it

              I stopped paying a year ago so the creditors long since stopped sending me statements. The collection agencies really didn't send me any statements either....just called A LOT.

                I think I was overly anal about saving my card statements (LOL and my all of the paperwork for my BK in general) BUT I had some auto-pays that occurred during the 90 days prior to my filing and I was worried about an AP - particularly from Navy Federal.

                  Yes, I still have the very last statement from each card. Good to know that's all I need. In the past, I sent them to the shredder.
