    Means Test Question

    Please forgive me if I'm asking a question that aught to be common knowledge, but I want to make sure I understand this correctly.

    If your income is below the median income level for your state, then you automatically qualify for Chapter 7, correct? It's only when you're above that you have to take the means test?

    Is that right?

    Think of the means test as Part 1 of 2 parts needed to qualify for a Chapter 7. The other part is your schedules...do you have negative income vs expenses? Or minimal disposable income? If so then you should be ok.

      You are not subject to the means test, however you do not automatically qualify for a ch.7. If you show a disposable income over $180ish on your schedules, then you may not qualify for a ch.7.
      Filed Chapter 13 on 2-28-10. 341 completed 4/14/10. Confirmed 5/14/10. Lien strip granted 2/2/11
