    Hi
    We are new to this forum and thank god for all your posts, it has answered a lot of questions.
    Out situation is DH works, I have been unemployed 2yrs, no employment now. we have a house we re modified, cc debt and a car loan.
    We decided a couple of days ago we cant do this anymore and basically this month have no money left to pay the mortgage. So we decided we are going to file BK, ch7 for us. This decision has been like a weight lifted off my shoulders. We contacted an attorney and are getting our paperwork together. However I have some questions
    1. I was offered a job today, minimum wage 40hrs a week, should I take it, can we still file for BK? working this job will not make us go into the black, we are still in the red every month
    2. we want to keep DH's car, do we just stay current on it and keep it out of any listing of debt for the attorney?
    3. People are saying we should look for a rental already? how long should we wait, I have heard up to 1yr, is that true?
    4. How much money can we save in an emergency fund that we can keep?

    First of all, welcome. You are among friends. Most here have been or are there, where you are at this time.

    When you decide to abandon your house, you will be surprised how long you can stay. I have heard up to three years so don't panic. This is not in stone so also be prepared for an eviction, yet that won't happen for some long time by the amount of work needed for that issue.

    About the car. You CANNOT keep anything out of your listings. EVERYTHING must be reported. Does not mean you can't pay through on the car. HIDE NOTHING.

    About the rental. Again, don't panic. Look yes but save your money be living in your house as long as possible. Not illegal at all. Keep reading our "stickies".

    Keeping emergency money depends upon your State's exemptions. Start to train yourself to Google stuff. You will learn much here. I'll tag along and watch your progress if you don't mind. 'Hub

      Hi, we are in the preplanning stages and are filing (only husband) chp 7 late this year. Read the preplanning area here and just start putting things in order (it makes you feel like you have some control and are actually doing something positive for your future). Set up google voice and start to "update" all of your creditors with your new phone number, this was once the calls start you will have them all in one place and they can identify you by your voice recording on GV. Also, you may want to change bank accounts to a bank where you have no afflilations (loans, CC etc) so that you do not chance them freezing your accounts once things progress. Just get all your ducks in a row and you'll be surprised how much better you feel. Ask questions here and retain your attorney (make sure you are very comfortable with the one you choose) and you should be just fine. Good luck!

        To both of you: Welcome to the forum. You are among friends here.

        To rps78: About the job--I want to say take it. Any job will help in this economy. But you have to weigh the pros and cons. If it costs you more in gas to get there and back, than what you are paid, it may not be worth it. Several years ago, I had my FT job cut to part time, and as I drove a 60 mile round trip to get to it, I could no longer afford going back and forth, and had to resign. That was in 1992.

        You don't say if there is any daycare involved. If there is, you have to factor that in also.
