SLS holds the 2nd mortgage on the rental we are surrendering (if the short sale does not go through before filing). We have missed 2 payments so far and they sent us an offer for a loan modification at a 50% reduction for 36 months? I plan on just ignoring this but wanted to check with you guys here first, is there something I should do (like: contact them and let them know we are not interested in a loan modification?) ? I guess we are worried it will look like we do not want to remedy the situation or work with the bank (we are not filing until end of year). Will the trustee look down on this and perhaps it will go against us at the 341?

Your not wanting a loan modification won't have any affect on your bankruptcy filing, or even be brought up at your 341 meeting. You're surrendering the home, they can't do a darn thing about it.Filed Chapter 13 02/2006 - Confirmed 05/2006 - Discharged 09/2011
