    Question about post bk and walk away house situation.....it's a little complicated!

    Okay gang. I have a question that I am hoping one of you may have an answer to.

    Our chapter 7 bk discharge occurred in April of 2010. At that time we did not reaffirm our 1st or 2nd mortgage. Our credit report shows us with zero liability with either mortgage. During the bk process and the time after that our home was up for sale for a total of a year and a half with no offers. We stayed in the home a total of 15 months not making any payments to either mortgage. In month 14 we received a notice from a local law firm stating that our "case" had been turned over to them but they had yet to review the details. At that point we decided to start fresh in a rental home in a neighboring community so we moved out. We assumed that our home was in "pre-foreclosure" given the legal paperwork and our return of keys with our letter stating we were no longer living there.

    Well now here we are......we have been out of the house for 2 1/2 months, the bank (or lawyers or whoever??) has put locks on all the doors, etc. and a good friend of ours knows someone who would like to buy the house.....great......except I have NO IDEA who they should contact or if I should even care?? Also.....they asked their Realtor to look it up and the Realtor said it is not even listed as "pre-foreclosure" and we are still listed as owners! Any ideas??? I am lost on this one!!

    in theory you abandoned the property - thats why the bank changed the locks; in reality however, until the deed changes out of your name, you are still the owner of the home.
