?'s Being Sued by HOA , Town, Lawn Care after BK discharge?

    that's really is a good point.

    i know in our case for our personal property...it is an FHA with PMI and the FHA requires a foreclosure to allow the bank to submit a claim to recoup the balance of the mortgage. however, since they refuse to foreclose, of course, how can the bank recoup the money? i mean who's calling the kettle black here???

    i also think with our personal situation, where Chase is paying all costs and fees and taxes and we were discharged and surrendered...who is it, that is going to sue us? Chase? for the maintenance fees and property taxes Chase paid? while i'm sure they may and most likely will try, but since the mortgage was discharged and we never paid and stayed etc. i just wonder where that will go. if Chase did go after us for those costs of course we would fight them. once again, in our personal situation, we don't have any liens or assessments from the town, city or county nor HOA.

    however, those that are getting assessments and liens against their properties from their towns, cities and HOA's after their discharges due to the banks not moving forward, i can see how that is going to present problems for many people.

    just an added note...the bank can quitclaim the deed back to the president of the USA...LOL!! then foreclose on it.

      In Ohio the Hoa can go ahead and foreclose superior to the banks, I am now starting to think that if our HOA back there is actually going that route that maybe we let them? If they want to take ownership the bank can then deal with them and they can hash it out! Or maybe we quitclaim it to the HOA??? Hmmmmmmm...

        yeah, if we can do this, but actually, what harm would it do even if we DID actually quitclaim deed the properties over???

        LOL!!! yes, quitclaim your property over to your HOA..ROFL!!!!!
