    Question getting married ?

    Hello BK family, I have a situation. I filed bankruptcy chapter 7.. 05/08 unfortunitly I aquired bad credit again . Credit score now is 501,503,501 purchased a car and a few utility bills. Anyway considering getting married and future wife wants to file chapter 7 to fix her credit. She states if we are married we both can file a chapter 7 and fix our credit. My question is, is this possible :blink : ? And what's the benifits of doing that this way? I want to thank anyone who is able to help me with this matter. You can also leave me a message here if possible. Again thank you for any help.

    She's wrong. While you can file a bk you simply won't be entitled to a discharge therefore your participation in the case has no benefit. You won't be entitled to a discharge until 8 years after your 08 filing date for a 7 and 4 years after your 08 discharge date for a 13.

      So if I understand you, you are saying that no matter what I am unable to file even if we file togetheras a maried couple I will have to wait until 2015 before I do another chapter 7? Wow! I may be dodging a bullet by not marrin her. Again she stated that as an individual I was unable to do it because I did the 7 over two years ago but as a couple we are able to do it.

        why not have your future mrs. file by herself BEFORE you get married?

          I don't understand how you word things, filing BK does not "fix" your credit. It allows you relief from your debts. You say you acquire bad credit, do you really mean you took on excessive amounts of debt post-discharge? They aren't the same thing. (for example, my hubby had bad credit, but not a lot of debt and I had a lot of debt, but a great credit score prior to filing our CH 13).

          And why are you saying you are dodging a bullet by not marrying her? Her ability to file BK is not affected whether you marry or not (she can file, if she hasn't filed in the prior 8 years) and neither is yours (you can't file, married or not).

          I think she is the one who needs to think carefully about the timing of marriage and BK filing. She may be eligible for CH 7 prior to marriage, but forced into a CH 13 if your combined income is too high once you marry. If that is the case, she should do the CH 7 prior to marriage, and you should consider whether or not a CH 13 filing in a year would help your situation. Even then she needs to consider whether or not she wants to be saddled with your debts and a CH 13 payment a year from now, since if you get married her income will be part of the DMI used to calculate your CH 13 payment, even though the CH 13 is not joint, just you filing.

          Plan Modified July 8, 2009 from $1100/month to $400/month due to change in income, finally discharged in July of 2013!
