    Mortgage lenders communicating with non-filing spouse?

    I know that after I file, the first and HELOC may stop sending statements and the HELOC may quit auto-withdrawing payments. How does that work when one party on the loans is NOT filing? Will they send to him?

      Hate to say it, but each individual is a responsible party. However, if anyone attempts to get to you through your spouse who is not listed on your contract/s, then they are breaking the law. Your spouse is like a cosigner, and will be sued in that instance if the debt is not paid. 'Hub

        I understand that; my main concern is that we continue to receive statements and that the HELOC payment, which is auto-withdrawn each month, is still withdrawn. I'll likely have to have DH talk to each lender just to make sure things are straight.

          With lenders, what "should" and "does" happen are not always one in the same. By all means, make sure DH calls the lender and asks about the auto debits. In fact, be prepared to pay by check if need be.
