Just another point of view. We are 63 days past our 341, so we're expecting our discharge any day. That said, we had a 3250/mo mortgage (3, actually) listed on our means test, and we haven't made a payment since January. We hadn't paid since October, but our lawyer suggested that we make a payment in January since we were proceeding as though we were going to keep the house. (Truth is, if all three lenders would work with us, we WOULD stay, but even the lawyer said there's no way three lenders will work together to get a modification and two settlements. But, I digress....) Point is, we were 90 days past due, we paid one payment to the first mortgage only in January, and then we filed in the middle of February. We had no problems. Just wanted to give you another perspective. We are in Central California (Eastern District). WantMyPeace - thanks so much for the info. Well, I received 2 identical letters today from NDEx West saying they have "been authorized by the Servicer/Creditor to initiate foreclosure of a Deed of Trust associated with a real property loan. The current creditor to whom the Debt is owed is U.S. Bank National Association, As Trustee for Citigroup Mortgage Loan Trust Series 2005-9. The loan is being serviced by America's Servicing Company."
I'm confused : I thought my lender was Wells Fargo. I don't know what Citigroup has to do with anything....they go on to say...
"Unless, within thirty days after you receive this letter you dispute the validity of the Debt or any part of it, NDEx will assume that the debt is valid." blah blah blah.....
Am I going to get a Notice of Default soon???? Seems awfully quick - I thought here in California, I had about 6 months before I would even get a Notice of Default. Is a Notice of Default required???? This doesn't look like a very official letter, but I'm a little sick over it...

There are a lot of MUCH MORE knowledgeable people on this forum, but it looks to me like your debt was sold to another company, and they're just letting you know that they have it now. OR, that they are acting as a servicer now. Someone who knows more will be able to tell you. Either way, that ISN'T a notice of default, and I suspect you have some time before you get there yet...--------------------------------------------
