    moving to another state for job

    Guys, I have a question, and I'm not sure where else to post it - first, I want to thank again everyone for helping me keep my sanity!

    At any rate, I was just told that I got a job that I applied for in a non-WAGE garnishment state...(I'm employed now, good job, etc., but this may be a nice fresh start...)

    So...I have a court case pending at home -where I am now, which will be stayed by Ch 13 filing I PRAY and HOPE this week or Monday next week.

    If we move, we'll still be able to pay Ch 13 to Trustee, BUT after about...oh, I'd say four months (per Nolo) we'd qualify for Ch 7....so...then would spouse and I have to file SEPARATE Chapter 7's - convert spouse's to 7 and me 7 separately?

    If we move to a no garnishment state, should we let our creditors know? So that they can't sue in our present state and get summary judgments?

    If yes, could we use a PO Box for our address?

    And once we move, do you all think that four months would be enough not to be sued by mort co, credit cards (around 90 days behind now), etc???

    Of course I haven't decided on move yet...personal decision making skills are not my best suit....

    People are sued everyday who live in non-wage garnishment states so by moving and telling your creditors you now live in a non-wage garnishment state isn't going to stop them from suing. They will sue because most judgments are good for 10 plus years. Also there are other ways to collect the judgment (levies of bank accounts and personal property).

      Right thanks! I know that they will sue...I'm just wondering if it'll put enough bureaucratic monkey-wrench in the works to give me a few extra months for Ch 7 - spouse will hopefully already be in Ch 13...
