    Car Wreck - Insurance Settlement

    A couple weeks ago, our daughter was rear ended by another car. Obviously their fault. Their insurance company finally contacted us.

    We went out to get a repair estimate today. $1200 and the body shop will send the car out to get the exhaust system checked by a professional company that does that stuff.

    I asked the guy if we could get the money instead of having the car repaired. Like people used to do in the old days. He said Yes we could. The body damage is pretty much limited to the bumper. No biggie to go get a bumper and do it ourselves. The body shop guy even said all we needed was a bumper and a couple brackets. It's a real easy job. And we could even reuse our existing end caps from the current bumper.

    Since the body shop will send the car out to have the exhaust system checked anyway, I thought we could get that done ourselves. If it needs repair, we could get a written estimate for that expense. Submit both repair estimates to the insurance company, and pay to have the exhaust repaired. Proper functioning exhaust is important. A dinged bumper isn't as important.

    I'm thinking we could use the insurance money for the bumper to pay the attny instead. Plus, now we'd have 2 repair estimates for that vehicle that would basically negate that car's value and free up Vehicle Exemption dollars for our other cars.

    Hubby worries that this could mess with our filing BK. That the insurance money could be considered income if we have them write the check to us.

    Any thoughts??!!

    It would be best if you didn't make a claim at all. Making insurance claims is a double-edged sword. If you have to do it, that's what it's there for. If you don't have to, it'll be better in the long run.

      The other kid hit my daughter in the rear. The accident was his fault. It's his insurance that's paying.

      They are already gonna pay our doctor bills and the scripts bill we paid for daughter's pain meds and muscle relaxers.

        You only talked about the bumper in the first post. You didn't mention your daughter's serious injuries. Is she okay?

          She's basically fine.

          She saw the car coming in the rear view mirror and turned around to look just as the guy's car hit hers in the rear end.

          She called me and I ran to be there with her. I got there within 5 minutes of the wreck and she was already complaining about back and neck pain.

          I figured the pain was partly due to the fact she was turned and because she knew it was coming she tensed up.

          We went to the doctor as a precautionary measure. Wanted a thorough exam to be sure there were no hidden issues that might crop up later.

          She was sore for several days, but she's young, and she's healed quickly.

          There were 5 or 6 kids total in the 2 cars. Our other daughter was riding as a passenger with Daughter #1. Nobody was hurt. It was just a fender bender.

            We were rear ended a few years ago. The other persons insurance not only paid for the car repair but a couple of thousand extra as well. We didn't even ask for that. Just be careful with the any medical issues. Don't sign any papers until you are sure there are no medical problems that need to be addressed. Sometimes you discover you are feeling better but in a few weeks you are still OK but not 100% and are not getting completely well. My wife fell into that situation about 15 years ago from a car wreck. Thought she was getting better, but then didn't get completely well. She ended up having to pay for a lot of Dr. bills.
