    What to do when you file BK and home goes thru foreclosure, but lender keeps sending

    We filed BK in July 2010 and were discharged in Nov 2010. This included our 1st and 2nd mortgage with the same company/Citi. Since and during, we have moved (gave the house back to bank to follow thru with foreclosure which is still in its process) in a rental. We are still receiving these one page advertisement/letters from our lender telling us to call them and they will lower our payment and put us on a plan. Funny we tried to do that for 2 years beforehand and didnt get very far.

    My question is....are they allowed to keep sending us this stuff? I am sure it just their standard mailing material like a form letter, but I am quite frankly SICK of receiving them. I would love to report them to someone, but who and how? Our attorney says to ignore those "call us" letters. We are basically one fish in a large sea and the lender cant get the fish right cause there are too many to be on top of perfectly. However on the foreclosure piece of it, that is still in the process and we will continue to be notified of what the lender needs to still "legally" do, to gain the house back technically. That I understand.

    I am sure I am feeling a bit spiteful, after going thru all of this, like many of you. What to do? Ignore these silly advertisements that try to get us to call....or?

    we were basically in a similar situation...except with chase.....

    we surrendered our house.... and our bk was discharged no asset...

    we moved out upon receipt of the first summons.... and after they rec'd the discharge on our bk they said WE re-opened our loan mod....right??!! they were crazy....

    we had been out of the house over 2 years....but all of a sudden they wanted to work with us?? well, we had moved 1700 miles away so they are SOL and i reminded them they refused to work with us for a year before we left...refused to work with our atty.......so why the chance of heart???? ( we have a general idea now that our mortgage was one that had improper docs and has prevented the bk to go into the foreclosure process...and they are SOL because we also have FHA with PMI but the bank can't collect a dime from the government until they foreclose and they can't foreclose unless they have proper documentation....HAAAAAAAAAA!!! ) ahhhhhhh too bad for them.

    ok...now...by law they cannot attempt to collect a debt, but they can attempt to reaffirm after the discharge...shoot they don't what our homes...LOL!! for us they called our bluff and now our house we left is over 200k under water...and it's ALL theirs.

    i would just dump the mail.....

      tobee43...WOW WEEEEE....lookie that. So what did you do why they were attempting to reaffirm? You didnt contact them did you? I just wonder how they can do that after the bankruptcy. Its all so damn shady, I cant stand it.

      Its so weird, looking back (one you have moved forward with your life and have walked away from all of that mess) how hard it all actually was and you made it thru. That is the thing that strikes me each time I think about it. I never thought we would make it thru this....let alone keep our marriage together...its was just hard on every aspect of your life. But now...life is good and I dont give a damn what anyone may think about what we did, why we did it, how we did it...all I care about is that we finally DID DO IT and man, what an experience. I wish I could write a book and tell people (esp those who are afraid--as we were PETRIFIED to do any of it) that its ok and you will be happy again....its true.

        it truly was one of the scariest things we ever did....actually....i'd rather go through child birth that what we went thu...LOL!! although, at this point i can tell you all the labor pains did in fact, produce a wonderful ending point for us.

        actually, the analogy of child birth pretty much describes are general experience! LOL!

        ahhhhhhh and the marriage thing...it was indeed shaky...after 40 years it tested every part of our relationship.it's bad enough to lose a job, but your house and everything you worked for, for 40 years gone in a blink....but then you wake up and "smell" the world...full of all different adventures. and, actually, we were trapped and stagnate...glued to the bills and slaves to our employers...so for us..maybe it was the best thing that ever happened to us...other than each other and our kids...just maybe it was a "good" thing...if that's possible.

        and thanks for your well wishes...the next chapter is the CLOSE of this house on FEB 15th...100% owner financed..and we have a "HOME" again... that is ours..
