I received a scary "restraining notice" - does this mean my bank account is frozen?

    I received a scary "restraining notice" - does this mean my bank account is frozen?

    I live in New York State but my bank account is domiciled in Delaware into which my paycheck gets direct deposited, and from what I understand, Delaware bank accounts are not subject to levies/freezing.

    Can anyone here confirm that this is the case? I don't want to wake up on payday with any unpleasant surprises.

    No, we are waiting for you to find out for us. You are the first one who has posted they have used the Delaware rules to attempt to avoid bank account levies.

    And your title to the post doesn't contain much information. Who did you receive the "restraining notice" from, and what did it say? Do you have a judgment against you?

        Ditto all of the above!

        DE does (I've looked into this quite a bit) prohibit its STATE chartered (small) banks from having bank accts levied/frozen (of course this doesn't apply to IRS, state tax, alimony/child support...I don't know about fed student loans...)

            karm43 - there are a few banks - look here: http://www.banking.delaware.gov/info...stitutions.pdf

            BUT BE CAREFUL!!! all of our friends :-) BofA , Discover, etc are there. Look for the SMALL LOCALLY (DE) Hq'd banks!!!!!

            Although many of them will require a trip to DE - I think one or two (I don't remember which) allow you to open online - BUT BUT BUT please make sure that you're dealing with LOCAL DE ONLY banks.
