Summary judgement to garnishment... how long do I have to file??

    ELS212, If you don't want to risk losing your money, go to the bank as soon as you possibly can, withdraw all the cash and close the account. The longer you delay, the more likely you will lose your money. Withdrawing the money is the only way to be certain it is safe. If you a have a lump sum that you can use to settle, contact Hanna with an offer AFTER you make sure your money is safe. Guessing what Hanna might do is useless and waiting for them to make a move is dangerous.

    Don't freak out. Just take action.

      That's probably what I'm going to do. I think I will direct deposit into a wal-mart debit card as others had suggested and hold out for January and file then. I hate to be rushed and do something wrong. My husband can open a checking account in his name only and we'll use his for paying rent, etc. He has no collection actions against him so I think he's safe.

      Here's something interesting though: I looked through about 50 cases in the system (In Georgia) with Fred Hanna/Capital One... with every single one that received a summary or default judgment, within a few days of the judgment they had obtained a FiFa and of course the ability to levy/garnish. They didn't do that with mine (yet.) How odd! I even thought for a minute that maybe the system just hadn't updated, but then I saw some that were updated 11/18/10 which is still nearly 6 weeks after my judgment. ???
