I need some answers from anyone who may have had the same issues or know why this may be happening. I filed last Dec 2009. I was an asset case because I had taken the homestead exemption and at the time of filing I had 2,400 in my account. I had to turn this over to my trustee. Otherwise,everything else was OK. I did not receive my 2009 federal tax return,which was 302.00. I recently went on the IRS refund site and it says it is still on hold. I was discharged in July 2010. Today I called my mortgage company to speak to them about my account. They informed me that they have a bankruptcy notice on the account so they cannot service me. They gave me another number to call but they are closed until tomorrow. My attorney has not responded to me yet. I don't understand,if I have been discharged why both the IRS and my mortgage company are not aware of this. Has anyone else had this problem? I certainly need to clear this up especially before tax time and so I can deal with my mortgage. My mortgage is current and was not included in the bankruptcy,but now I am nervous.

It appears that my case has not closed. I just received a letter with the distributions and the court date is Nov. 30. I hope that will close the case. My trustee never took my return but it has not been sent to me because there is a bankruptcy listed. SO, hopefully when the case closes and the bankruptcy stay is lifted, I will receive the refund (2009). Not sure what the rules are in CA. I did get my state refund. When I called the bankruptcy division of my mortgage, they told me they were waiting for the case to close. I cannot ask for loan mod or anything else unless I involve my attorney. Since I believe the case will close in Dec. I am going to wait. I wish you luck and I wuld speak with your atty regarding any holds they may put on your taxes. My atty never returned my phone call. Guess he feels his job is done
