    Job Loss - Bankruptcy Option Question

    We met with a lawyer today here in Orlando. My husband unexpectedly lost his $70K a year job and we are trying to decide what to do. As an FYI, we are not late on any payment at this point but that day is coming close.

    1. Our monthly income after his job loss is $5574 gross (my salary + his mil pension).

    2. We have two $225 car payments and we have about $68K in unsecured debt, not including a $66K 2nd mortgage.

    3. The house was worth $390K a few years ago. It is now worth $150K and the 1st mortgage is underwater by $25K at this point so we could strip the 2nd in a Chapter 13 if we wanted to keep the house. However, the real estate market is horrible here and values are now not projected to return to decent levels for another 15 years or so. We were about 8 yrs away from his retirement but everthing has changed now. Operating cost for the house is an additional $500 to 600 per month if you factor in electric, water, garbage, sewer, HOA fees, termite bond and floor insurance (no emergencies in that cost). Homeowners insurance and property taxes are included in the $1257 monthly mortgage payment. As an FYI, even though the house value dropped considerably, the taxes actually went up on the property.

    4. Very, very little short-term savings because we were trying to pay off unsecured debt. Any savings we have is in 401K (still trying to recoup the damage there) and our pensions -- and even those are considerably less than they were a few years ago due to pension changes by our companies or his job loss.

    5. The job market is horrible, nearly 12% unemployment and he is 58 and getting rejections on job occupations that he has worked in before.

    Our lawyer asked us what we want to file although he did explain both options. I guess I want to file whatever is going to give us the best option to try to not end up on the street when neither of us will be able to work. It sounded like we would not be eligible for a Chapter 7 although he said he might be able to argue the loss of income due to job loss but we are obviously above the median income. I ran a budget where we would keep the house in a Chap. 13 but even with trimming, we come out with less than $100 in monthly disposable income once my husband's 6-month run of unemployment insurance runs out. Because $1600 of our income is from a military pension with no survivorship benefit (I know!!), if anything happens to him during that 3 to 5 year Chapter 13 repayment plan, that income will disappear. The lawyer said I could convert to a Chapter 7 then but where could I live with my credit rating at that point? Right now our credit rating borders on good/excellent.

    My mother thinks I am making a big deal out of all of this but then she owns her own house and lets my brother and his girlfriend live there for free. Her response to my expressing my concerns is that at least my husband is alive. I am losing sleep over this and my husband is going through somewhat of a grieving process due to the unexpected job loss. I have to think for two these days so any constructive guidance would be most appreciated.

    i really understand if feels like panic mode right now...you are doing the right thing about thinking in advance what to do for your future.

    we where in "generally" the same situation as you, however, we both lost our jobs..and had to face the fact...after using our draining our savings to cover things for so long we just had to make the decision to file.

    while you may not be at that point yet...you need to decide if you can cut back and just live off your salary by cutting back and on his unemployment etc.

    if you find you have to file, it will not be the end of the world for you and your family...you just need to handle the best you can. however, only YOU will know what is the best path for you.

      DeeDee195 - We are also in Middle District Florida and are over the median by about $17,000. This does noy include my husband's unemployment compensation, which is excluded from the means test and your monthly income calculations in our district. We just filed a Chapter 7. Being over the median income does not exclude you from being able to file a 7, and considering your circumstances, I would personally be very hesitant to enter into a 13. My husband has been looking for a job for over a year and has not gotten an single interview - even for retail jobs.

      I would work out a budget on your income alone and determine if you can afford to keep your house or not. You should check out local rental rates to see if it would save you anything to rent. We spend $1325/mo in rent for an apartment.

      It's good that you are thinking about this now. We didn't even consider it until recently, and now the unemployment compensation is about to run out. We kept hoping a job offer would come before now.

          You have hit the nail on the head. I know that I cannot afford the house on my own and with an apartment, can avoid at least the upkeep costs on the large house (HOA-enforced) which could get steep. Higher electric/water costs, gotta replace a large tree with another large tree if the other one dies, has to be St. Augustine water-hungry grass, etc.

          I ran the means test that's available online for Middle Florida and didnt even alter their rent allowance of $885 and it still indicated that there was no abuse presumed. In fact, we still came out not having enough disposable income for a 13. I know that they usually look at the last 6 months for income averaging but my husband's job income is gone. If at all possible, I'd be interested in the name of your attorney. I kept getting the feeling that the 13 was being pushed--and I know that they get more for a 13 rather than a 7. Thanks!

            deedee........we TOO...were seemingly being PUSHED into a 13.......one of the atty's here insisted our UI WAS included...it was such a FIGHT...we did find a wonderful atty in florida that did really help us through this...and our case was really complex compared to others doing a chapter 7....

            also...just a note...i just started a group on this forum...a discussion group for florida filers, i did it yesterday...it really seems like maybe we can help network through this crazy system ....or at least try to help one another through this mess. i'm in the group...LOL!! all by myself right now since it's just up...but maybe it's a place we can get together and put some good info on...i hope!

            we are thankfully done...but i cannot begin to tell you the planning that was involved....literaly interviewing 6 attys here in florida...most of them didn't even know WHAT they were doing!! it was downright scary!! we had to do our own pushing and pulling...that's for sure!!

            i have seen people on this forum doing very well with a 13.......i consider those people very brave souls....as to me it was the worse possible scenario because i felt like someone would have us by the neck for maybe the next 3-5 years....that would have been a nightmare for us...really.


            by the time we filed we had lost our home of 33 years, surrendered one car...sold our clothes, furniture...everything last thing to put a roof over our heads and food on the table...NOT something i suggest to anyone!

              So sorry to hear your husband lost his job, I hope he can find something very soon. I just wanted to ask you if your husband has checked with OPM to see if he can add you as Survivor for his benefits? I know there are clauses that apply, however if he is able to add you (Open season is coming up I believe) I would do so. My father passed away a few years ago but before he passed he thought my mom would receive his mil. retirement.... come to find out he didnt pay for the option either. It used to be that it was an automatic thing, however I believe sometime in the late 90's to early 2000's - Congress changed the law - requiring a "pay for service" fee, or something to that affect.

              Definitely check with OPM - if he has that option to add you, I wouldnt hesitate to do it.

                We were trying for a Ch13. 'Hub had a reasonably reliable contracting job (computer/network consulting) and Social Security, and paltry pension. I had a good FT job and a PT job. The pre-filing credit counselor ran our numbers and said that she thought we were better suited for a Ch7, rather than the Ch13, as our outgo was larger than our income. We thanked her for the information and went on our way.

                THEN, I lost my FT job and we had no choice but to file the CH7. In looking back, I am glad it happened that way. I don't think we would have made it through a CH13.

                  DeeDee - (love your name, btw) I don't think our attorney would do you any good, since we are in Northeast Florida (same filing district as Orlando, though). You will want one close by in case you need to run paperwork to their office. We have had to do that multiple times. Keep searching around until you find an attorney you are comfortable with and arm yourself with information. Even though our attorney came recommended, we still have to "educate" him occassionally.

                    Yep, sounds real familiar! My DH lost his job in 2007 unexpectedly, after 19 yr. making real good money, he is in his fifties. Three years later, he could not find a decent job, Ohio is a black hole for employment, he did find a job, but it pays one third of what he used to make. If you are over fifty you are really screwed when trying to find a new job in this depression. We tried for two years to keep up with bills and all, finally realized we were now in a position where we had no choice but to file BK and start over, even at our age. Wish we had actually came to this realization sooner!

                      Before you choose to file BK you have to try to set up a budget to fit your newly loss of income. What can you do to lower your expenses? One quick possibility is to sell your cars and by cheaper paid for cars. This could free up $550/month. Don't worry about your unsecured debt. That should be your least priority.

                      Just remember one thing. By filing BK won't raise your income. If you draw up a budget and can't make it through a month with out your debt. BK will not help you.
