I just spoke with an attorney's office who provides "full service" representation (foreclosure, bankruptcy, short sales, debt representation, etc.) My original plan was to file BK7 and include my home in the BK (walk away, let it go to foreclosure). After speaking with today's attorney, I was told that for $XXXX they will represent me in a short sale. For another $XXX, they will represent me with my debt collectors. They suggested I put on hold - or cancel - my plans to file BK with my BK attorney. They said that after all this time of not paying cc's ($30K total debt; 4 months of non-payment) that it is highly unlikely that any will sue; debt will just charge off. Today's attorney said his role is two-fold; sell the house in a short sale and to "tell" the cc's to leave me alone permanently (w/o filing BK). Sounds logical but what am I missing? One key point: I already have one BK7 on my record; due to come off 3/2011. Any guidance or suggestions would be greatly appreciated.

Well I was not sued for 18mos for my credit cards. then capone sued me. So they will most likely sue, as these debt buyers attorneys need the money so they buy the debt for little or nothing and sue you. I will say 2 of my sons stop paying their cc in 1990's and noone sued them. but now I think the debt buyers are running after the debt looking for people who cannot file chptr 7 and will settle. I called one attorney who wanted me to just let him settle, no way ,my credit is already damaged. bankruptcy.chpt 7 ,5-2009

I have been told by 2 different lawyers for a short sale, that I pay NOTHING. Might want to check that out. I chose BK instead and may still let a short sale happen afterwards just to get it out of my name and let my relative who is a realtor make some money. But they should be making their money from the sale of the house, not you. That is how I understood it.
