    Question can i reopen my BK to include another debt a year after discharge?

    i have a mortgage that i requested be left out of BK when i filed which it was but now i would like to include it. is it possible to reopen the file to include a debt? ive been discharged a little over a year.

    im in Florida.

    i believe it may be too late...however, you just may have to let the house go into foreclosure...and you know what's going on here in florida now...it may take forever and a day.

    i would call the atty who handled your bk...or even another one...i know although i live in florida now, the state i came from had a NO cap FEEs on foreclosures and also was a state that allowed the bank to collect the deficiency between what was owned on the mortgage and what the bank sold the house for...

    be really safe with this one...call and get legal advise.

      All your debts would have been listed in your bankruptcy petition. Unless you signed a reaffirmation agreement with your lender during your bankruptcy, the note should be discharged. If you are not sure what you signed please pick up the phone and call your attorney. Good luck to you.
