    A Secret Bankruptcy

    Hello,

    My boyfriend's father has recently filed for bankruptcy. His father kept quiet about the whole situation until the day he actually filed it, and we still don't really understand how bad the situation is. This is the only information that he has told us; he needs to get rid of the car.

    A few months after the bankruptcy, he is asking to see his boyfriend's pay stubs. All he said was that it was required for the bankruptcy for 9 months. I know that isn't the duration of the bankruptcy, it's for a certain amount of years. He didn't say anything else about it, and when his son asked him for more details, his father would get angry and threaten to kick him out. I was a bit confused when my boyfriend told me this, and I asked a friend about it. My friend told me that if my boyfriend has nothing to do with the bankruptcy, then there is no reason why his father needs his pay stubs. We will never hear any addition info from his father since he is reluctant to tell. It seems he is doing something sneaky because he will not tell the family anything.

    1. Can someone tell me if his father taking his pay stubs is a requirement of bankruptcy?

    2. If it isn't a requirement, can someone tell me what the father's possible intentions are with the pay stubs?

    3. If anyone has the slightest clue why his father needs to see his pay stubs for 9 months, though the bankruptcy will last for years, that would be great.

    If this was posted in the wrong section, then I'm terribly sorry.

    Im assuming he filed a Ch 13 since u mentioned it will last for years, correct?

      Since you list your state as "Ontario" I am assuming you are in Canada. I hate to say it, but you won't find too much help here since most members are from the U.S. and have filed BK in the U.S.

      But, does your boyfriend live with the father? If yes, then the BK court is probably just trying to verify the total of HouseHold Income.

        It might be that the son's income is being considered as part of the household income, if he is living with his father. But without more info, it is going to be hard to guess. Also, if you are in Ontario, as in Canada, I am certain that the Canadian BK laws are a bit different.

            Household income is considered when filing bankruptcy. If his father filed a chapter 13 bankruptcy and it's set up to be reviewed periodically, they'd want proof of household income at each review. This means that if your b/f is contributing the household expenses, the court will want to know to what extent he is doing so... this affects how much his father will pay per month to the bankruptcy court.
