I just got a letter from another attorney that lives 80 miles away and never had contact with me. He said Capital one was suing me as of Oct 6 and to contact him if I didn't have a lawyer yet. He told me to look up the details on casenet which I did and sure enough I have a court date for Nov. 11! My lawyer hasn't even told me about this yet. We have our lawyer paid and are reworking our paperwork since they couldn't figure it out so we haven't had a real set down meeting with him yet.
Do they serve summons on weekends? I will be taking this letter and what I printed off of casenet to my lawyer Monday. Does this mean I still have to show up for the court date? I don't know why they haven't served me yet if it was filed on the 6th. under the docket entries it says "Summons Issued-Associate". on Oct 8.
