    Question Need a few questions answered

    This last two years have been a nightmare- first had some unexpected occurances that was beyond our control and we are now thinking about filing for chapter 13. we have paid our bills on time and never been late. But as the months go by it has been harder and harder. First the intrest on some of our cc have gone through the roof which did not help and then we had unexpected att fees for a year,then found out husband has a brain tumor, mother has stage 4 cancer. Of course we had the car need about 4000 in work done. If I did not have bad luck I would have no luck at all. LOL My question is my husband recives a military retirement and our state they it is tax empept how dose that work? Also my husbands income has gone down due to the ecomy and we do have 401K and stock options. The other question is should we wait till the first of the year or should we start now?

    VA disability is tax exempt, military retirement isn't. Not sure what you are asking.

      Sorry to hear about your bad luck RJK, but what would you be waiting for to file? Is there something you want to drop off your 6-month look-back? If not, and you have the attorney's fee, then by all means start filing right away. You definitely should get a lawyer if you can. It doesn't seem like you have any assets, so your case should be an easy Chapter 7.

        rjk...i so agree with drowning....you should file and just get it over. it is very clear you cannot take anymore stress...you have enough on your plate.

        it's just great...and this makes me so SICK and angry about how these banks raised our interest rates and have driven US to the ground!!!

        then WE feel guilty we have to file bankruptcy. i just don't get it...one is going along making their payments like they have for years...even paying over the min. and all of a sudden the bank decides to up your interest rate to 39.9% and a monthly payment that is impossible to make...so they are forcing us down. on purpose. while everyone just has to sit and take it.

        file now...do NOT pass go....the sad part is whatever the banks charge off they get back from our tax dollars we paid to the government. it's a sad thing!!

            One thing that wasn't mentioned: With your husbands health if you still have medical bills coming in then wait to file. Right now perhaps I would call and make appointments with a couple of attorneys and get their advice. (Interview more than one). Be sure to keep any ongoing medical bills in the your mind though when thinking about the timing.
