    Question Help needed.

    I won't get into the long story since it seems we all have some variation of the same. I filed yesterday and now have a question. I moved from my home into a mobile home in which I am buying with a lease to buy contract. I received the long time home owner tax credit by amending my 2009 tax return and received the money in August 2010. It was $4,000.00 worth. I spent it on appliances for the new home and furniture since I sold everything to pay some debts but now being sued so had to file.

    My attorney said I didn't have to disclose this to the court, but now I am wondering if I should have.

    well, i think it may depend on where you are what type of bankruptcy you filed. if it's a 7 i believe your alright, but i'm not certain about a 13...i think you may have had to report that...someone that's in a 13 can better answer than i.

    all i know is we had a substantial return a few months before filing and i was told get rid of it NOW...actually...i was also on of the items on our "list" determining when to file our bk.

    we got the money spend it ...also on our new place and it was never questioned in the chapter 7.

      You did not need to disclose how you spent your 09 refund to the Court. There is always a possibility that your Trustee will ask but it sounds like you can show what happened to the $$. I trust you listed the appliances and furniture on Schedule B.

      You should be fine.
