I believe it is the trustee's job to try to be as fair as possible to both sides. I know our's was.

In any case, our trustee, while working for the creditors, was very fair and considerate of us. We made so many stupid mistakes, that we should have been dismissed."To go bravely forward is to invite a miracle."

Forewarned is forearmed. The devil you know is better than the devil you don't. Etc, etc.
If, as advertised, the TT is of the asset aggressive variety, at least you know going in how to best prepare and what hot buttons the TT will be looking for. Shouldn't be any surprises. Most of us don't know what to expect. Sometimes a "fair" person in an adversarial position (and a TT is an adversary) can be more aggressive than the self proclaimed provided there is reason.
I researched our TT prior to our 341 and all I found out was that he also represented debtors which I thought was a good sign. The TT was fine and no surprises. Best of luck.

Some attorneys have a way to foretell what trustee will be assigned, based on time of filing, pattern recognition and feeding the blood of small animals to a big statue they keep in their back offices. Seems like yours was bad luck or bad timing. In any event, nothing to fear. Just make sure exemptions are accurate.

We had not discovered this forum at that time. If we had, things would have been handled far differently.

while you may have been lucky to have a "fair" trustee...it is their job to question any and all parts of the bankruptcy you file...thus to some they seem "mean"....but it's just their job.
to me the idea is make certain the atty you retain in your area has the connections with the courts to help you thru it. i'm most certain we got a trustee that was best "suited" for our situation because of our atty...just a thought...i know i can't prove it. but i do believe it as being true.8/4/2008 MAKE SURE AND VISIT Tobee's Blogs! http://www.bkforum.com/blog.php?32727-tobee43 and all are welcome to bk forum's Florida State Questions and Answers on BK http://www.bkforum.com/group.php?groupid=9
