FYI..Changing the name to blank does nothing from keeping anyone from finding the article.

      Just saying.....

No, that isn't the way it works--at least in our District of Middle Florida. Here, it is a random chance drawing, and I don't think there is a possibility to challenge the decision. There might be, but it wasn't for us to question the process at the time we were going through it. My 'Hub and I were such uneducated boobs--thanks to our attorney. We had not discovered this forum at that time. If we had, things would have been handled far differently.

In any case, our trustee, while working for the creditors, was very fair and considerate of us. We made so many stupid mistakes, that we should have been dismissed.

@Logan. I know. Didn't care. I don't care about people finding it. I care about someone claiming slander.

Forewarned is forearmed. The devil you know is better than the devil you don't. Etc, etc.

If, as advertised, the TT is of the asset aggressive variety, at least you know going in how to best prepare and what hot buttons the TT will be looking for. Shouldn't be any surprises. Most of us don't know what to expect. Sometimes a "fair" person in an adversarial position (and a TT is an adversary) can be more aggressive than the self proclaimed provided there is reason.

I researched our TT prior to our 341 and all I found out was that he also represented debtors which I thought was a good sign. The TT was fine and no surprises. Best of luck.

I have the same feeling, too, gmk, because my trustee also represents debtors.

Some attorneys have a way to foretell what trustee will be assigned, based on time of filing, pattern recognition and feeding the blood of small animals to a big statue they keep in their back offices. Seems like yours was bad luck or bad timing. In any event, nothing to fear. Just make sure exemptions are accurate.

actually, i know that...it was basically rhetorical. however, the trustee is NOT your friend...he or she is acting on behalf of the CREDITORS........NOT in your interest.

while you may have been lucky to have a "fair" trustee...it is their job to question any and all parts of the bankruptcy you file...thus to some they seem "mean"....but it's just their job.

to me the idea is make certain the atty you retain in your area has the connections with the courts to help you thru it. i'm most certain we got a trustee that was best "suited" for our situation because of our atty...just a thought...i know i can't prove it. but i do believe it as being true.

This is guilt plain and simple. I accidently bounced a check about a month ago and it took me days to stop thinking about it. I can understand the stress... when it's over, you'll feel so much better.
