I recently had my first meeting with my BK atty, now I have to wait 4 months before I can file BK. I just thought of something I forgot to ask my attorney of my many debts I hope to discharge two belong to AMEX one is a Delta card and the other is a Starwood card. My question is I have had the Delta card for about 12 years and the Starwood card for about 5 years if both those cards are discharged can AMEX reclaim the miles and points deposited into my Delta acct and Starwood acct? Thanks!

Amex will close your account and lock you out of the points as soon as they get wind of your bk plans (maybe sooner if you have any negative credit on your report) They closed our card within a month of losing job, no payments were even late yet. We had to petition them to grant access to our points, which they did only after we paid the final bill in full.
Grab your points NOW!!!! Cash them in, order a gift card, whatever you can do to get the balance to 0. They will be gone and unrecoverable very soon.
ETA: I am not sure how it works with Amex if the points already rolled out to your *wood and delta accounts. We were told all United points would leave our account when the attached visa was cancelled by United, the points were already rolled to United ff number. Call starwood or delta points customer service and ask them "if I close my amex account will amex pull my points back?" CLOSE is the closest you want come to saying anything specific. Do not mention Bankruptcy! Just say close. Dom't give them a reason to tell amex you are a risk before you have a chance to file.Last edited by Maine; 08-13-2010, 02:42 PM.I am not an attorney.
