    Opening a checking account

    Hi,

    I had a creditor who gave us blank checks to use in connection to our line of credit 2 years ago. We wrote out a check to ourselves and deposited into our checking account (for contracting work being done on our home). The bank released the funds immediately because we were good clients. Turns out two weeks later, the creditor returned our check and said that we were not appoved after further research due to debt/income ratio. Too make the long story short, we were severly overdrawn on our bank account. The bank close out our account, we got reported to telecheck. We are still paying them back, but minimum amounts.

    Question- once I include this bank into my chapter 13 bankruptcy, will we be able to open another checking account? It is very hard not being able to have your direct deposits and check writing capabilities.

    You need to try and get another account opened before you file bk. With you already being reported to chexsys or telechek, it's going to be difficult. After you bk, it will be even more difficult.

      I have found that once you file bankruptcy and include the previous banks, you can contact TeleCheck or ChexSystems and they will remove the entries (or "clean up" the entries) for anything prior to your filing date!

      I too had 2 entries in ChexSystems due to the two banks using their right of offset on my accounts right after filing. At first, ChexSystems wouldn't remove them because they happened post-petition. However, when I converted to Chapter 7, they removed them because they were pre-conversion. (I know, sounds complex, but it worked for me.)
