Paid retainer fee, but wish to ditch the lawyer

    Paid retainer fee, but wish to ditch the lawyer

    I am willing to take the $500 loss, but basically what will happen?

    I haven't signed any papers yet at the lawyer's office.

    Just curious what happens next:

    1)the retainer is gone and I get calls and mail again?

    2)I won't be able to file again in another 7 years?

    3)any more details would be great!

    Depending on what is stated in the retention agreement you signed along with your lawyer to retain his/her services, you may or may not get back part of that retainer depending upon what has been done for you since the retention. You will have to take that up with that particular attorney. I don't understand why you are asking the rest of your question....if you don't file bankruptcy, you don't have a filing date that that would prevent you from filing within the next 7 or 8 years. Of course if you ditch your attorney, you are back where you started.

      thanks so much! i thought with the retainer in place, that itself would prevent filing again until 7 more years. thanks for quick response!

        Not quite - its the actual filing of your case that starts the clock, and that is assuming the filed case leads to a discharge. If so, then you cannot file another ch. 7 for 8 years.

        Such as if you file on 7-31-2010, you cannot file again until on or after 7-31-2018.

        Get mortgage modified: DONE! 7 months of back interest payments amortized, payment reduced over $200/mo
        (In the 'planning' stage, to file ch. 13 if/when we have to.)
