Bank foreclosed on my house today. I would like to keep our car. We have credit card debt in collections.
I'm not sure if we file for 7 or 13?
Filling Chapter 7 is complete and less expensive. Your credit is toast anyway. It depends on your assets and income.
Go for 7 if you are able.
BTW, welcome to the forum. You are among friends and helpers. 'Hub
If I knew it all, would I be here??Hang in there = Retained attorney 8-06, Filed 12-28-07, Discharge 8-13-08, Finally CLOSED 11-3-09, 3-31-10 AP Dismissed, Informed by incompetent lawyer of CLOSED status, October 14, 2010.
We have income again, and are in a really good place financially. (as far as supporting ourselves, etc)
No assets other than the car now that the house is gone. (is my husbands 401k an asset???)
It is an asset, but not counted nor can it be attached in any way. DO NOT!!! dip into it. Once you take it out, pay the penalties, rob your future, pay the tax, then it belongs to the Trustee. DON'T EVEN THINK OF THIS.
However, go for 7. 'Hub

In fact- I am thinking of asking my husband to increase the % he puts in before we file.
Because they just foreclosed today, I have a couple pay checks (stubs to collect) before I have to file. I think. I have not paid the credit cards in close to a year. (when my husband lost his job)
